The Village Board of the Village of Newark finds that there have been increased cases of larceny within its jurisdiction and adjacent jurisdictions. In many cases, attempts have been made to sell stolen property to dealers of secondhand articles for cash. It is the intention of this Board to adopt this chapter which requires recordkeeping and a holding period by such dealers which will assist in making the sale of stolen property more difficult, will help in the recovery of identifiable property and will discourage larceny in and around the Village of Newark.
Every person, firm or corporation engaged in the business of dealing, purchasing, selling or acquiring secondhand articles shall, before 10:00 a.m. of each business day, prepare a report of all articles received since the accounting of the previous business day. This report shall be furnished to police on request in a form and manner specified by the Chief of Police.
The business shall be required to maintain a copy of these daily reports for a period of five years. These reports shall contain an accurate description of each article acquired, including but not limited to make, model, size, serial number, color, markings and any additional descriptions which would tend to allow identification of the property by an owner thereof.
The report shall contain the name, address, date of birth and social security number of the person selling the item to the business. This information shall be obtained from an identification document, such as a driver's license or government-issued identification, which contains the above information and a physical description or photograph of the individual. Social Security cards, birth certificates, library cards, etc., shall not be considered sufficient forms of identification.
The business acquiring secondhand property shall be required to hold said property for a period of five business days prior to offering it for resale.
Auto dealers, bulk estate sales, real estate brokers and firearm dealers shall be exempt from the provisions of this chapter. They shall, however, be required to comply with the documentation required of them by state and federal laws.
Enforcement of this chapter shall be the responsibility of the Newark Police Department.
A violation of any of the provisions of this chapter shall be punishable by a maximum fine of $250, or by imprisonment for 15 days, or by both such fine and imprisonment.
