§ 144-1 Adoption of standards.

Certain documents, three copies of which are on file in the office of the Township of Lower Moreland, being marked and designated as the "2000 International Plumbing Code," including Appendix Chapters B, C, D, E, and F, as published by the International Code Council, be and is hereby adopted as the code of the Township of Lower Moreland for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the Township of Lower Moreland and providing for the issuance of permits, collection of fees, and registrations of plumbers therefor; and each and all of the regulations, provisions, conditions and terms of such International Plumbing Code, 2000 edition, published by the International Code Council on file in the office of the Township of Lower Moreland are hereby referred to, adopted and made a part hereof as if fully set out in this chapter.

§ 144-2 Revisions to adopted standards.

The following revisions and deletions to the 2000 International Plumbing Code are hereby established as follows:
A. 
Section 101.1 of the 2000 International Plumbing Code is revised by the insertion of "Lower Moreland Township."
B. 
Section 106.6.2 of the 2000 International Plumbing Code is deleted in its entirety and replaced with the following:
106.6.2 Schedule of permit fees: A fee for each permit shall be paid as required, in accordance with the schedule as established by resolution adopted by the Board of Commissioners from time to time.
C. 
Section 106.6.3 of the 2000 International Plumbing Code is deleted in its entirety.
D. 
Section 108.4 of the 2000 International Plumbing Code is deleted in its entirety and replaced with the following:
108.4 Violation penalties: Any person, firm or corporation who shall alter or cause to be done any work on any plumbing facilities without the permit required by the 2000 International Plumbing Code, or who shall fail to comply with any of the requirements of the permit, or of the 2000 International Plumbing Code, or who shall fail to comply with any regulations, orders or directions of the Code Official or his designee, or who shall in any way violate any provision of the 2000 International Plumbing Code, shall be liable, on conviction thereof, to a fine up to $1,000 for each and every offense, together with the costs of prosecution, provided that whenever such person shall have been notified by the Code Official or his designee, or by service of legal process, or in any other way that he or she is committing such violation, each day in which he or she shall continue after such notification shall constitute a separate offense punishable by like fine or imprisonment.
E. 
Section 108.5 of the 2000 International Plumbing Code is deleted in its entirety and replaced with the following:
108.5 Stop-work orders: Upon notice from the Code Official, work on any plumbing system that is being done contrary to the provisions of this code or in a dangerous or unsafe manner shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner's agent, or to the person doing the work. The notice shall state the conditions under which work is authorized to resume. Where an emergency exists, the Code Official shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine as set forth by Section 108.5 of the 2000 International Plumbing Code as applied by Lower Moreland Township.
F. 
Section 109.0 of the 2000 International Plumbing Code is deleted in its entirety and replaced with the following:
109.0 Appeals: Whenever it is claimed that the provisions of the 2000 International Plumbing Code do not apply, or that the true intent and meaning of the 2000 International Plumbing Code have been misconstrued or wrongly interpreted, an appeal may be taken from the decision of the Code Official or his designee, pursuant to the Local Agency Law,[1] amended by the Board of Commissioners.

G. 
Section 305.6.1 of the 2000 International Plumbing Code is deleted in its entirety and replaced with the following:
305.6.1 Sewer depth: Building sewers that connect to private sewage disposal systems shall be a minimum depth below finished grade at the point of septic tank connection as required by the Montgomery County Health Department. Building sewers shall be a minimum of 18 inches below finished grade unless the Code Official approves a lesser depth.
H. 
Section 904.1 of the 2000 International Plumbing Code is revised by the insertion of the number "12" where the number of inches is specified.

§ 144-3 Registration of plumbers.

A. 
Master plumbers.
(1) 
All master plumbers duly registered and licensed in Lower Moreland Township at the time of the passage of this chapter shall not be required to undergo an examination, and they shall be entitled to register for the current calendar year.
(2) 
Master plumbers who are not registered or licensed in Lower Moreland Township and who desire to engage in the business of plumbing and/or building drainage in the Township shall apply to the Code Official for registration and shall be required to show satisfactory completion of examination or registration recognized by Lower Moreland Township.
(3) 
All plumbers who are not registered or licensed as master plumbers in Lower Moreland Township and who desire to become master plumbers to engage in the business of plumbing and building drainage in Lower Moreland Township shall apply to the Code Official for registration and shall be required to take an examination, recognized by Lower Moreland Township, before receiving such registration.
B. 
Journeyman plumbers.
(1) 
All journeyman plumbers duly registered and licensed in Lower Moreland Township at the time of the passage of this chapter shall not be required to undergo an examination, and they shall be entitled to register for the current calendar year and annually thereafter.
(2) 
All plumbers who are not registered or licensed as journeyman plumbers in Lower Moreland Township and who desire to become journeyman plumbers in Lower Moreland Township shall apply to the Code Official for registration, and they shall be required to show satisfactory completion of examination or registration recognized by Lower Moreland Township.
C. 
Fees. Fees for any registration shall be provided in Chapter A214, Fees, adopted by the Township Board of Commissioners by resolution from time to time.
D. 
Revocation of registration. The registration granted under this chapter may be suspended or revoked by the Code Official when a master plumber, journeyman plumber, firm or corporation, or the registered representative thereof, shall violate any of these rules and regulations and shall refuse or neglect to make the necessary corrections to work not approved by the Code Official within a reasonable time after written notification or who shall permit use of his, their or its name by a person or persons for the purpose of obtaining a permit or permits to do plumbing and drainage work or to do any work under his or their registration or license.
E. 
Applications. All plumbers desiring to engage in the business or work of plumbing and building drainage in Lower Moreland Township shall apply, in writing, to the Code Official for registration and license. The Code Official shall examine the application and determine if the applicant is qualified for certification or, if not, if he/she is required to take an examination. After proper examination, if said person shall be found competent, the same shall be registered by the Code Official for a period of one calendar year, or fraction or part thereof, entitling said person to engage in the work of plumbing and building drainage.
F. 
Register. A register of all plumbers entitled to engage in the work of plumbing and building drainage, for the calendar year, will be kept in the office of the Code Official, which register shall be open for inspection to all persons interested therein.
G. 
Violations and penalties. Any person or persons who shall violate any of the provisions of this section, upon conviction thereof, shall be liable to pay a fine or penalty not to exceed $1,000 for each and every offense, together with the costs of prosecution, provided that whenever such person shall have been notified by the Code Official or by service of legal process, or in any other way, that he is committing such violation, each day in which he shall continue after such notification shall constitute a separate offense punishable by like fine or imprisonment.

§ 144-4 Register.

A register of all applicants and licenses or certificates issued will be kept in the office of the Plumbing Official, which register shall be open for inspection to all persons interested therein.

§ 144-5 Violations and penalties.

Any person or persons who shall violate any of the provisions of this article, upon conviction thereof, shall be liable to pay a fine or penalty not to exceed $1,000 for each and every offense, together with the costs of prosecution, provided that whenever such person shall have been notified by the Plumbing Official or by service of legal process, or in any other way, that he is committing such violation, each day in which he shall continue after such notification shall constitute a separate offense punishable by like fine or imprisonment.
