In recognition of the fact that the business district of the Incorporated Village of Bellerose serves as the gateway to the Incorporated Village of Bellerose and presents that face of the Incorporated Village of Bellerose which is most visible to nonresidents, the Board of Trustees views it as essential that efforts be made to upgrade the appearance of the business district and to assure its vitality, while at the same time recognizing the need for the establishment of various business enterprises within the business district to serve the needs of the residents of the Incorporated Village of Bellerose. The Board of Trustees intends, by enacting this chapter, to provide for the upgrading of the business district of the Incorporated Village of Bellerose and for its maintenance, in accordance with the various other provisions of the Code of the Incorporated Village of Bellerose, in a viable, dignified and useful fashion.
The Board of Trustees of the Incorporated Village of Bellerose hereby creates the Business District Development Commission, hereinafter called the "Commission."

A. 
The Commission shall consist of three, five or seven members, who shall be appointed by the Mayor with the approval of the Board of Trustees. One of them shall be designated as Chairman. One of the members of the Commission may be a Deputy Village Attorney of the Incorporated Village of Bellerose. Vacancies on the Commission shall be filled in the same manner as the original appointment, except that a vacancy occurring other than by the expiration of a term shall be filled only for the remainder of the unexpired term. Beginning April 1, 1993, the terms of all Commission members shall be for a period of two years.
B. 
Any Commission member serving at the time of the adoption of this amendment shall complete his/her term in full. Any new member appointed between the adoption hereof and March 30, 1993, shall serve an initial term expiring on March 31, 1993.
The Chairman of the Commission shall have the power to issue and to serve, upon owners and users of property within the business district of the Village of Bellerose, summonses in cases arising in connection with the violation of the provisions of the Code of the Incorporated Village of Bellerose and in cases arising in connection with the violation of the various ordinances, resolutions, orders, local laws and rules and regulations regularly adopted by the Board of Trustees of the Incorporated Village of Bellerose, pursuant to the provisions of § 46-1 of the Code of the Incorporated Village of Bellerose.[1]

The Commission shall adopt rules and procedures for its meetings and shall keep accurate records of its meetings and activities and shall file an annual report as provided for in this chapter.
The powers and duties of the Commission shall be:
A. 
To advise the Board of Trustees on matters affecting the business district of the Incorporated Village of Bellerose.
B. 
To develop and, after receiving general approval by resolution of the Board of Trustees, conduct a program for improvement of the business district of the Incorporated Village of Bellerose.
C. 
To conduct studies, surveys and inventories within the business district of the Incorporated Village of Bellerose, such as may be necessary to carry out the general purposes of this chapter.
D. 
To see to the enforcement, in cooperation with other enforcing authorities and officers of the Village, of the provisions of the Code of the Incorporated Village of Bellerose within the business district of the Village.
E. 
To seek to coordinate, assist and unify the efforts of private groups, institutions, individuals and businesses within the Incorporated Village of Bellerose in accord with the purposes of this chapter.
F. 
To maintain liaison and communication between the owners and users of property in the business district of the Incorporated Village of Bellerose, on the one hand, and the government of the Incorporated Village of Bellerose, on the other hand.
G. 
To recommend, from time to time, to the Board of Trustees, features, plans and programs relating to the upgrading of the business district of the Incorporated Village of Bellerose and for the maintenance of the business district and the businesses contained therein in a dignified fashion, in accordance with a Master Plan, to be drawn up by the Commission, which shall be submitted to the Board of Trustees for its consideration.
H. 
To see to the uniform enforcement, throughout the business district, of all the provisions of the Code of the Incorporated Village of Bellerose.
I. 
To carry out such other duties as may be assigned from time to time by the Board of Trustees.
The Commission shall submit an annual report to the Board of Trustees, not later than the first day of April of each year, concerning the activities and work of the Commission and from time to time shall submit such reports and recommendations as may be necessary to fulfill the purposes of this chapter.
The members of the Commission shall receive no compensation for their services as members thereof but may be reimbursed for reasonable and necessary expenses incurred in the performance of their duties, within the appropriations made available therefor.
This chapter shall be deemed an exercise of the powers of the Incorporated Village of Bellerose to preserve and to improve the quality of the business district of the Incorporated Village of Bellerose on behalf of the present and future inhabitants of the Incorporated Village of Bellerose. This chapter is not intended to and shall not be deemed to impair the powers and duties of any other organ of government within the Incorporated Village of Bellerose.
