It shall not be lawful for any owner, lessee or occupant of real property in the Village of Lindenhurst to cause, suffer or allow or permit any dried grass, weeds or brush or any wastepaper, rags, boxes, barrels or any other flammable or combustible waste materials to accumulate or remain upon the premises under his care so as to be likely to cause fire or communicate fires to neighboring or adjoining buildings.
Every owner, lessee or occupant of real property upon which there may be dried grass, weeds or brush or refuse, boxes, barrels, excelsior, shavings or similar flammable or combustible articles or substances likely to catch fire and thereby cause loss or damage shall forthwith clear the premises of all such combustible or flammable material.

The Fire Chief of the Village of Lindenhurst or the Suffolk County Police Department may serve a notice, in writing, either personally or by mail, on any owner, lessee or occupant of real property in the Village to remove and destroy all flammable or combustible waste, growths or accumulations or refuse or rubbish thereon likely to cause or spread fires. Failure to serve said notice shall not be construed as the absence of a violation of this article.

A person so served who two days after service shall neglect or fail to comply with any such notice shall be deemed to have violated this article and shall be liable to all the penalties thereof.

Any person, corporation or association violating any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not less than $50 nor more than $1,000 or a term of imprisonment not exceeding one year, or both.
