As used in this article, the following terms
shall have the meanings indicated:
Includes one or more persons of either sex, natural persons,
corporations, partnerships, associations, joint-stock companies, societies
and all other entities of any kind capable of being sued.
A.
No person shall place, consent to or cause to be placed,
keep or suffer to be kept any stone, timber, lumber or other materials
for building or any box, barrel, cask or any article or articles,
substance or substances whatsoever upon any of the streets, highways
or public places within the Village of New Hyde Park so as to obstruct
or impede in any manner the free and clear access thereto or passage
thereover in a free and unhampered manner at all times, unless such
person or persons, firm or corporation shall first obtain from the
Board of Trustees a permit therefor signed by the Clerk of the village,
limiting the area and location of such obstruction.
B.
No person shall alter or disturb the grade of any
village street, sidewalk, highway or public place within the Village
of New Hyde Park, nor shall any person disturb any sidewalk or the
paving upon any village street or highway or public place within said
village nor dig up or excavate nor lay or construct any sidewalk nor
grade any such street or highway, unless such person shall first obtain
from the Board of Trustees a permit therefor signed by the Clerk of
the village, limiting the area and location and duration of such disturbance,
which permit shall not be granted unless the person desiring the same
shall pay the sum of $0.25 for each street opening of the area between
the curbline and the lot line; the sum of $5 for a road opening and
the sum of $10 for a road opening which involves the tunneling of
one side of such road to another, including sidewalk areas, which
sums shall be retained by the village for all subsequent repairs to
such street, avenue, road or highway.
With each application for street opening which
involves the breaking of paved or permanent sidewalks, there shall
be deposited with the Village Clerk the sum of $5 as a guaranty that
the sidewalk will be restored to the same condition as before within
a reasonable time, such restoration to be made under the direction
of the Village Engineer or Street Committee of the Board of Trustees,
and the surface of any disturbed area shall be replaced in the condition
existing previous to the excavation or digging. Further, if after
notice, the property so disturbed is not immediately restored, then
the village shall restore said property and pay for the same out of
the deposit above mentioned.
No person shall obstruct, cover or bridge or
cause to be obstructed, covered or bridged a street or sidewalk or
the gutter of any roadway or any public place in the village without
first procuring written permission from the Mayor or the Board of
Trustees of the village. Permission shall be conditioned upon the
placing of red lights or flares from dusk until dawn on either side
of any obstruction and that care shall be exercised to have the gutter
of any roadway clear for the passage of water.
Garbage and ashes in proper receptacles may
be placed on curb for removal on the days specified therefor. Papers
must be placed in bags or firmly tied in bundles before being placed
out for removal.
