A. 
It shall be unlawful for any owner of any taxicab, limousine, livery or private livery van to operate or to permit or cause the operation of such vehicle upon the public streets and highways of the village, unless that owner shall have first obtained and shall have in force and effect an owner's license therefor, as hereinafter provided. It shall likewise be unlawful and shall constitute a separate offense under this chapter for any owner of any such regulated vehicle to direct, allow or cause the same to be operated upon the public streets and highways of the village by any driver not in possession of a valid and current driver's license issued by the village under and pursuant to the provisions of this chapter. For the purposes of this chapter, where and when the use or placement upon a motor vehicle of any registration plate, license medallion, roof light, business name or inscription, paint scheme or any other or similar device, sign or design identifies or is likely to identify that vehicle as a taxicab, livery, private livery van or limousine for hire, and the owner or driver of such vehicle shall stand or park such vehicle at or near any train station, bus stop, taxi stand, gasoline or service station, club, hotel, motel, restaurant, cabaret, parking lot, public street or highway or other public place within the village and shall either actively communicate the immediate availability for hire of such vehicle to or shall otherwise solicit such business from any member of the public, such conduct shall constitute an act of operating such vehicle upon the public streets and highways of the village.
B. 
Every owner's license issued hereunder shall be issued as of the first day of January or subsequent date of issue and shall expire on the 31st day of December next succeeding its date of issuance, unless sooner canceled or revoked.
C. 
Every person who desires to operate a vehicle regulated under this chapter and owned or controlled by such person, within the village, shall make written application to the Village Clerk, verified under oath, upon a form or forms prescribed and furnished by the Village Clerk, and requesting the issuance of an owner's license as required by this chapter. The owner shall provide and complete all information required on the application form or forms and shall submit any other relevant information, records or documents deemed necessary or advisable by the village in order for such owner to establish that the public convenience and necessity will be served by the issuance of such license.
D. 
Upon the application for license, the owner shall itemize and identify the number of regulated vehicles to be operated by the owner, together with a description of each such vehicle, including its make, model, year of manufacture, motor and vehicle identification numbers, passenger seating capacity and New York State Department of Motor Vehicles registration number, and shall provide the street address and location of any and all terminals and depots proposed to be used by the owner in connection with its operations within the village.
A. 
Upon receipt of a completed and verified application for an original owner's license, the Village Clerk shall make a determination as to whether or not the public convenience and necessity will be served by the issuance of an owner's license to the applicant. A written memorandum of such determination shall immediately be filed with, and as a part of, the record on such application, and a copy of such memorandum shall be forthwith delivered to the Board of Trustees.
B. 
Upon its receipt of the Village Clerk's memorandum, the Board of Trustees, prior to its consideration of the application for an original license and its approval or rejection of the Clerk's determination, shall cause to be published in the official newspaper of the village a notice, stating that application has been made for the licensing of a vehicle or vehicles under this chapter and listing the number of such vehicles sought to be licensed, the business name and address of the proposed owner and the address of any terminals or depots proposed to be operated in connection therewith. Such notice shall also contain a statement that written arguments as to whether the public convenience and necessity will be served by the issuance of such license must be filed with the Village Clerk on or before the date fixed therein, which date shall be not less than eight days after the date of such publication. Any arguments so filed shall be considered by the Board in making its decision whether to grant or deny such license.
C. 
If, after compliance with the foregoing procedures, the Board of Trustees shall decide to grant or deny the license requested hereunder, then it shall file an order with the Village Clerk setting forth its determination. If such order shall grant such license, then, upon certification of each vehicle proposed to be operated under such license, and the furnishing by the applicant of all proof of insurance as hereinafter required, and payment of all fees in connection therewith, the Village Clerk shall issue the license, stating and fixing the number of vehicles authorized for operation thereunder and the date of issuance thereof. If such license shall be denied under such order, then the Village Clerk shall immediately notify the applicant that such license has been denied.
D. 
In making any findings or conclusions in their respective determinations, the Village Clerk and the Board of Trustees shall take into consideration the number of similar regulated vehicles already in operation in the village, particularly in the area in which the applicant proposes to locate its terminals and depots; whether existing transportation is adequate to meet the public need; the probable effect of additional licensed vehicles upon local traffic and parking conditions; and the character, experience and responsibility of the applicant and the adequacy of the service which the applicant proposes to give. Before the issuance or rejection of an owner's license, the Village Clerk and the Board of Trustees, or either of them, may require the applicant and any others having knowledge of the facts to submit to an examination under oath and to produce evidence relating thereto or may hold a hearing upon such application as hereinafter provided.
A. 
Whenever the holder of any owner's license issued under this chapter shall desire to add to the number of regulated vehicles then authorized by, and covered under, such license, such owner shall make written application to the Village Clerk upon the forms furnished and prescribed by such officer for such purpose.
B. 
If the Village Clerk shall find that the addition of such regulated vehicles will serve the public convenience and necessity, then such Clerk shall be authorized to issue a supplementary owner's license stating the name and address of such owner, the number and description of the additional authorized vehicles and the date of issuance of such supplementary license; otherwise such application shall be denied. In making any determination authorized by this section, the Village Clerk shall take into consideration the matters specified in § 177-7 of this chapter.
C. 
Any supplementary license issued under this section shall expire on the same date as the original license which it replaces and may be renewed in the same manner and for the same periods as any such original license.
D. 
The fees for any application for a supplementary owner's license shall be paid at the time of filing such application, and the fees for every such license shall be paid prior to its issuance.
A. 
No person shall operate any vehicle for hire regulated under this chapter, upon the public streets and highways of the village, without having first obtained and having in current force and effect a New York State chauffeur's license and a village driver's license, issued to and for that person as hereinafter provided.
B. 
Every driver's license issued under this section shall be issued as of the date of the granting thereof by the Village Clerk and shall expire on the 31st day of December next succeeding its date of issuance, unless sooner canceled or revoked.
C. 
Every person who desires to drive a vehicle regulated under this chapter, within the village, shall make written application therefor to the Village Clerk, verified under oath, upon a form or forms furnished and prescribed by such officer for such purpose. The applicant shall provide and complete all of the information required on such form or forms and shall submit any other relevant information, documentation or records as may be required by the Village Clerk in order to determine whether such applicant is qualified to obtain such driver's license, including but not limited to the applicant's New York State license, his fingerprints, any record of convictions for traffic, parking or other offenses and any character references who may be able to attest to the sobriety, honesty and general good character of the applicant.
D. 
Every application for a driver's license under this section shall, at the time of its filing with the Village Clerk, be accompanied by a photograph or photographs of the applicant, the number, size and other requirements for which shall be fixed and determined by rule or regulation of the Village Clerk; and, if so required by rule or regulation of the Village Clerk or by resolution or order of the Village Board, each such applicant shall be fingerprinted under the direction and supervision of the Village Clerk.
E. 
Upon receipt of a completed application for a driver's license under this section, the Village Clerk may refer the same to the New York State Division of Criminal Justice Services for whatever investigation thereon such agency shall deem necessary or desirable, and whatever report thereon it may deem appropriate and advisable; and where and when the fingerprinting of an applicant shall have been undertaken under the authority of this section, a copy of such fingerprints shall be submitted with the application to the foregoing agency.
F. 
If the Village Clerk shall determine that an applicant for a driver's license is qualified under the provisions of this chapter, possesses any requisite New York State license or license endorsement and, in light of the applicant's police record and evidence of his character, is a person apparently fit and proper to drive a regulated vehicle for hire, then the Village Clerk shall issue such license; otherwise, such license shall be denied.
No owner's license and no driver's license issued under the provisions of this chapter shall at any time or under any circumstance be transferable, unless and except as specifically authorized and approved by prior resolution or order of the Board of Trustees of the village.
The fees and charges for all original applications, referrals, licenses, license medallions and permits, and for the renewals, replacements or reissuance thereof, shall be those fees or charges prospectively adopted, from time to time, by resolution or order of the Board of Trustees, as set forth and appearing in Article III of Chapter 1, General Provisions, of this Code.
