A.
This chapter shall be known and may be cited as the
"Vehicle and Traffic Code of the Village of New Hyde Park" or as the
"VTC-NHP."
B.
It is hereby established that, for the purposes of
this chapter, certain of the words and phrases used in this chapter
are intended to have and shall have specific legal or technical meanings
and definitions as respectively ascribed to them by statute or local
law. Accordingly, and in order to effectuate such purposes and intent:
(1)
Words or phrases used in this chapter shall be interpreted
to have the meanings respectively ascribed to them either under the
provisions of Article 1 of the Vehicle and Traffic Law of the State
of New York (the "Vehicle and Traffic Law" or "VTL") or under the
provisions of this section and this chapter.
(2)
In the event that any word or phrase used in this
chapter shall be separately defined in both Article 1 of the VTL and
the provisions of this section, then the provisions of both such definitions
shall be read together and construed so as to provide a single, comprehensive
meaning; provided, however, that to the extent any conflict would
arise as a result of such construction, then the provisions of this
chapter shall be deemed superseding and controlling for the purposes
of this chapter.

Subject to the provisions of Subsection B of this section, the following words and phrases, for the purposes of this chapter, shall have the meanings respectively ascribed herein:
Includes any vehicle (other than a personal passenger vehicle
or suburban or a motorcycle or a specialized vehicle as defined in
VTL § 401, Subdivision 16b, or a motor vehicle specially
registered pursuant to VTL § 404-a or displaying a special
parking permit issued thereto under VTL § 1203-a) which
is primarily designed, constructed, used or maintained for the transportation
of goods, merchandise or other property or for the livery or transport
of passengers for hire or compensation, whether on a profit or nonprofit
basis, or for the livery or transport of children to or from school
or camp or as the power unit for the hauling of freight or cargo by
trailer or semitrailer or any combination of trailers and semitrailers;
or for any of the special purpose commercial uses listed or described
in VTL § 401-7F.
The prolongation of the lateral line of a curb or, in the
absence of a curb, the lateral boundary line of a roadway, adjoining
the paved or traveled portion of such roadway.
New Year's Day, Martin Luther King Day, President's Day,
Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans
Day, Thanksgiving Day, Christmas Day and any other day declared by
the Board of Trustees of the Village to be a local legal holiday.
The official time standards in force under state or federal
law and having application within the Village. Whenever any hours
are stated within the provisions of this chapter or upon any traffic
control device or within any rule, order or regulation adopted in
accordance with the provisions of the Vehicle and Traffic Law or this
chapter, they shall mean and refer to the prevailing time standards
specified herein.

The Village shall install and maintain traffic
control devices when and as required under the provisions of this
chapter, to make effective the provisions of this chapter, and may
install and maintain such additional traffic control devices as it
may deem necessary to regulate, warn or guide traffic under the Vehicle
and Traffic Law of the State of New York, subject to the provisions
of §§ 1682 and 1684 of that law.
A.
For the purpose of maintaining an accurate record
of all regulations adopted under the provisions of this chapter, there
is hereby established a system of schedules, appearing as Article
X of this chapter, in which shall be entered all regulations after
adoption. Such schedules shall be deemed a part of the section to
which they refer. All regulations shall be adopted with reference
to the appropriate schedule as indicated in the various sections of
this chapter.
B.
Regulations shall be adopted by the Board of Trustees
in accordance with provisions of the Village Law and the Vehicle and
Traffic Law, or by an officer or agency authorized by the Board of
Trustees to adopt regulations pursuant to § 1603 of the
Vehicle and Traffic Law.
