A.
No vehicle shall be parked or permitted to stand in
the nonmetered portion of the parking areas listed below situated
in the Village of New Hyde Park, unless a permit to park such vehicle
in said parking area has been obtained from the Clerk of the Incorporated
Village of New Hyde Park, as hereinbelow set forth:
B.
All such parking permits shall be issued by the Village
Clerk, subject to the approval of the Board of Trustees, in accordance
with applications and forms approved by the Board of Trustees. All
vehicles for which such permits have been issued shall have conspicuously
displayed on the left rear bumper of the vehicle a distinctive tag
or decal issued by the Village Clerk bearing the number of such permit
and the year for which the same shall be valid.

A.
For any person residing in or owning property within
the Village, hereby classified as a "resident" for purposes of this
article, the fee for such permit shall be $50 per year or any part
of a year. For any person not residing in or owning property within
the Village, but who is regularly employed by or who owns a place
of business within the Village, hereby classified as a "nonresident
employee" for purposes of this article, the fee for such permit shall
be $60 per year or any part of a year. For any other person, hereby
classified as a "nonresident" for purposes of this article, the fee
for such permit shall be $100 per year or any part of a year.

B.
All classifications of permits provided for in Subsection A above shall be for a single calendar year, January 1 to and including December 31 next succeeding, and shall be issued solely to natural persons; and the fees therefor shall not be prorated over any period, nor shall any part or portion of such fees be refundable.
C.
The fees provided for in Subsection A of this section may henceforth be amended as to each classification by resolution of the Board of Trustees. However, in no event shall any amended fee schedule henceforth adopted be retroactively applied to any permit issued prior to the date of such resolution, for the calendar year in which such resolution is adopted.

With respect to special districts under Schedule
XXVI[1] of the Village Code:
A.
The annual
permit fee for a Special Parking District permit for parking in a
special district located in or adjoining a business, commercial or
industrial zone shall be $400 per permit. Replacement stickers for
original permits lost, stolen, damaged or destroyed prior to expiration
shall be $100 each. A Special Parking District permit holder may park
in any "A" permit spot and shall not be limited to a specific zone.

B.
The annual
permit charge shall be paid at time of issuance of permit, and no
part or portion of such charge shall be refundable after issuance
of such permit, for any reason. Permits issued shall cover the period
January 1 through December 31.

With respect to special Class B residential on-street parking permits, as authorized by § 189-34 of the Village Code, it is hereby ordered that no more than two such permits shall be issued at any time for any single residential parcel qualifying for such permits; and no parking zone limiting use of the on-street space to Class B permit vehicles shall at any time extend, or be deemed or construed as extending, beyond the side or other lot lines of a qualified permit parcel running perpendicular to such street or portion thereof so zoned and limited to and for such permit use.

Pursuant to the provisions of Article III of Chapter 1 of the Village Code respecting residence requirements and proof of residency for applicants seeking resident-restricted parking permits issued and required by the provisions of this Chapter 189 of the Code or resolution or order adopted under such chapter, the following shall apply:
A.
The Village Clerk or other designated issuing agent
of such parking permits shall require proof of residency of such applicant
(including but not limited to a current New York State driver's license)
showing the principal legal residence of such applicant to be located
within the corporate limits of the Village of New Hyde Park, New York.
B.
For each vehicle of such applicant sought to be issued
a resident-restricted permit, such applicant shall be required to
submit a title certificate and/or current New York State registration
certificate certifying registration of each vehicle at the aforesaid
principal residence address of the applicant within the Village.
C.
When an applicant seeks a nonresident employee parking
permit issued by the Village, proof of employment shall include a
letter on the official letterhead of the applicant's Village employer,
certifying that such employee is duly and continuously employed by
that employer, and signed by the owner or an officer of the employing
agency. In such event, the employee shall still be required to produce
a New York State driver's license and title or registration certificate
showing the principal legal residence of the applicant and the vehicle
for which the permit is being sought.
D.
When a vehicle is leased or is assigned by a business
firm or other registered owner to an applicant otherwise residing
within the Village and seeking a resident-restricted permit, proof
of such lease or assignment shall be submitted with the applicant's
driver's license and the title or registration certificate registered
in the name of the leasing agent, business firm or other registered
owner.
No permit, distinctive tag or decal shall be
transferred from one owner to another or from one vehicle to another
without the approval of the Board of Trustees and the endorsement
of such approval in writing on such permit by the Village Clerk.
A.
When any vehicle is parked or abandoned on any highway
or public parking lot within this Village during a snowstorm, flood,
fire or other public emergency which affects that portion of the public
highway or parking lot upon which said vehicle is parked or abandoned,
said vehicle may be removed by or under the direction of the Village.
B.
When any vehicle is found unattended on any highway
or public parking lot within the Village where said vehicle constitutes
an obstruction to traffic, said vehicle may be removed by or under
the direction of the Village.
After removal of any vehicle as provided in
this article, the Village may store or cause such vehicle to be stored
in a suitable place at the expense of the owner. Such owner or person
in charge of the vehicle may redeem the same upon payment to the person
with whom stored of the amount of all expenses actually and necessarily
incurred in effecting such removal and storage, such storage charges
not to exceed the rate or charge as may be fixed from time to time
by the Board of Trustees.
It shall be the duty of the Village to ascertain
to the extent possible the owner of the vehicle or the person having
the same in charge, and to notify him of the removal and disposition
of such vehicle and of the amount which will be required to redeem
same. Said Village shall also without delay report the removal and
disposition of any vehicle removed as provided in this article to
the Village Clerk.
