Billiards — See Ch. 56.
For the purposes of this chapter, the following definitions shall be
applicable unless the context indicates to the contrary:
Any business establishment in which there are located pool or billiards
tables for patron use, four or more coin- or token-operated games or coin-
or token-operated automatic amusement devices, including but not limited to
pinball machines or computer-type automatic amusement devices.
Any individual, natural person, joint-stock company, partnership,
voluntary association, society, club, firm, company, corporation or any other
group acting as a unit.
A.
Arcades are prohibited.
B.
Any person operating a business establishment, within the corporate
limits of the Town of Selbyville, in which there are located no more than
three coin- or token-operated games or coin- or token-operated automatic amusement
devices, including but not limited to pinball machines or computer-type automatic
amusement devices, but excluding pool or billiards tables, shall pay an annual
license fee as set by resolution of the Town Council from time to time. Such
fee shall be due and payable under the same circumstances and in the same
manner as real estate taxes.
C.
This section shall not apply to the private use of tables and
devices in private homes.
D.
This section shall not apply to churches, fire department or
other nonprofit organizations; such exclusion applies only to pool and billiards
tables and devices provided for members only.
A.
Any person violating any of the provisions hereof shall
be deemed guilty of a misdemeanor and upon conviction in a court of competent
jurisdiction shall be fined not less than $25 nor more than $100 and shall
pay the costs of prosecution, including Town Attorney fees and Victims' Compensation
Fund assessment.
B.
For the purposes of this chapter, each day that a violation
continues shall be deemed to be a separate offense.
