It shall hereinafter be unlawful for any person to carry an open container
of any alcoholic beverage, or to consume any alcoholic beverage, on any street
or public area or building, or to carry an open container of an alcoholic
beverage or to consume any alcoholic beverage in any vehicle located on any
street or public area within the Town of New Hartford, at any time, except
in certain areas as designated by the Town Board of the Town of New Hartford
as picnic or recreation areas, and such areas are designated as such by the
placement of signs thereon.
A violation of this chapter for a first conviction thereof shall be
punished by a fine of not more than $50 or by imprisonment of not more than
five days, or both; and for a second conviction within 18 months thereafter,
such person shall be punished by a fine of not more than $75 or by imprisonment
of not more than 10 days, or both; and upon a third and subsequent conviction
within 18 months after the second conviction, such person shall be punished
by a fine of not more than $100 or by imprisonment of not more than 15 days,
or both.
