The Board of Supervisors of Lower Providence
Township may, from time to time, amend, supplement, change, modify
or repeal this Part 1 by proceeding in the following manner. The Board
of Supervisors, by resolution adopted at a regular or special meeting,
shall fix the time and place of a public hearing on the proposed amendment
and cause public notice thereof to be given as follows:
A. By publishing a notice thereof once each week for
two successive weeks in a newspaper of general circulation in the
Township.
(1)Â The first notice shall not be more than 30 days or
less than 14 days from the date of the hearing.
(2)Â The notice shall state the time and place of the hearing,
the general nature of the proposed amendment and that full opportunity
to be heard will be given to any citizen and all parties in interest
attending such hearing.
B. Whenever a proposed amendment affects a particular
property, then there shall be posted upon said property or premises
at such place or places as the Board of Supervisors may direct a notice
of said proposed amendment.
Before adoption, all proposed amendments shall
be referred to the Township Planning Commission and the Montgomery
County Planning Commission at least 30 days prior to the public hearing,
for recommendation and report. These recommendations are advisory
and shall not be binding on the Board of Supervisors.
Nothing in this Part 1 shall be construed to
affect any suit or proceeding pending in any court or any rights acquired
or liability incurred or any cause or causes of action acquired or
existing under the Montgomery County Subdivision Regulations of 1950,
as amended; nor shall any just or legal right or remedy of any character
be lost, impaired or affected by this Part 1.
