There shall be established a Stadium Commission.

The Commission membership shall consist of the Haverhill High School Athletic Director, the Haverhill High School Principal, a member of the Touchdown Club, a member of the City Council, a member of the School Committee and four at-large members. All members of said Board will be appointed by the Mayor; however, the Athletic Director and Principal shall hold office by virtue of their positions. The Athletic Director, Principal, City Council and School Committee representatives shall hold office only for the period that they are incumbents of their respective positions. The terms of the Commission members shall be for three years, and all Commission members shall serve without salary or any compensation or remuneration. The Haverhill High School Athletic Director shall serve as Chairperson, who shall preside at its meetings and otherwise act on behalf of the Commission when so authorized. If the Athletic Director declines to serve as Chairperson, then the Commission shall annually elect a Chairperson.

Said Commission shall have cognizance, general direction and direct control over a ceratain parcel of land known as "Haverhill Stadium," bounded by Lincoln Avenue and the acreage known as "Riverside Park" and "Nettleton Avenue."

With the consent of the School Committee for a period of up to three years at a time, the Commission shall have the responsibility to govern, control, maintain, operate and promote the stadium facility, including the exclusive right to sell advertising rights within the stadium, and on the outside walls with the approval of the School Committee. Any advertising agreement which term exceeds the current term of the lease, or any donation in excess of $10,000 which will result in a permanent improvement to the facilities, shall require approval of the School Committee.

The Commission shall have its own operating budget as approved with the City of Haverhill's annual operating budget with the understanding that the City of Haverhill, if the need arises, will still assume fiscal responsibility for the improvements, maintenance, repairs, staffing, supplies and utilities. The Commission shall provide to the Mayor, City Council, and School Committee, on an annual basis, a copy of its financial statement. Any funds generated through advertising or other revenue enhancement sources shall be added to the stadium revolving account and maintained separately from any operating account.

All stadium personnel will remain under the direct control of the Athletic Director as employees of the School Department, with the understanding that the Haverhill Public Schools and the City of Haverhill shall share equally in the expense of one staff person who performs routine duties.

Each lease term approved by the School Committee shall specify that school activities shall be given absolute priority over any other use of the stadium. School activities shall be allowed in the stadium at no charge to the School Department or the City of Haverhill. All revenues realized from school-related activities, such as football games, but not limited to that sport, shall be returned to the School Department budget.
