A.Â
There is hereby established a Harbor Commission, hereinafter
called the "Commission," which shall consist of not fewer than three
members nor more than seven members. The Harbormaster for the City
of Haverhill shall be a nonvoting member of the Commission.
B.Â
All members shall be appointed by the Mayor.
All members shall serve for a one-year period.
Members of the Commission shall serve without
compensation.
A.Â
The Commission is hereby established for the following
purposes as they relate to the waterways of the City of Haverhill:
(1)Â
Recommend ordinances for adoption by the Mayor and
City Council consistent with any river and waterways management plan
ultimately adopted.
(2)Â
Recommend to the City Council and the Mayor a river
and waterways management plan to encourage boating, fishing and recreational
use of the Merrimack River and to regulate and encourage boats, boating,
and public and private dock space on the river.
(3)Â
Review and make recommendations to the Mayor and the
City Council on proposed water use activities on the river and contiguous
to the river.
(4)Â
Work with the US Coast Guard, the Army Corps of Engineers
and other state and federal agencies insure proper and efficient use
of the river.
(5)Â
Adopt policies, rules and regulations for the safety
of persons using the waterways;
(6)Â
Adopt policies, rules and regulations insuring compliance
with state and municipal laws, as they relate to the use of the waterways.
(7)Â
Adopt policies to assist in the protection of the
waterways; and in the promotion and development of the use of the
waterways.
(8)Â
Adopt policies, rules and regulations regarding the
placement and use of docks, floats, moorings, float piers, and other
docking mechanisms to insure safe navigation on the waterways and
to designate areas of the river that are safe for navigation.
(9)Â
Recommend, if they deem it advisable to do so, to
the City Council and the Mayor fees and charges for the use of the
waterways, docks, floats, moorings and other docking mechanisms with
all fees to be used as a revolving fund to maintain the harbors, docks
and waterways.
B.Â
The Commission may adopt rules and regulations governing
the use of land and waters under its control.
C.Â
The Commission may prescribe penalties, not exceeding
a fine of $100, for any violation thereof of any regulation.
