There is hereby established, pursuant to N.J.S.A.
40:61-22.24, a municipal swim club commission to be known as the "Cresskill
Municipal Pool Commission."
The Commission shall consist of a Board of Commissioners
comprised of five members, all of whom shall be residents of the Borough,
to be appointed by the Mayor with the approval of the Council. The
initial terms of two members shall be for three years, that of two
additional members for two years and that of one member for one year.
Upon the expiration of the aforesaid initial terms, all subsequent
terms shall be for three years. Vacancies shall be filled for unexpired
terms only.

The Commissioners shall serve without salary
or other compensation, but their necessary expenses shall be allowed
and paid by the municipality. During service on the Commission, no
member shall be entitled to or receive a discount on his or her membership.
Any provision contrary hereto shall be of no force or effect even
if contained in the Commission’s rules or bylaws.
A.
The Commission is hereby empowered to advise and consult
with the Mayor and Council concerning the planning, organization and
construction of municipal swim club facilities; to generally supervise
and control the maintenance, operation and regulation of the Cresskill
Municipal Swim Club, including, but not limited to, the setting of
annual membership fees (subject to the approval by resolution of the
Mayor and Council); and to enforce regulations to be adopted by the
Mayor and Council governing the maintenance and operation thereof.

B.
A permanent standing subcommittee is hereby established,
which subcommittee shall be empowered to oversee the maintenance,
repair to and upkeep of the Cresskill Municipal Swim Club grounds,
buildings and pool.

Said subcommittee shall be empowered to retain the
services of and enter into contracts with such contractors as the
subcommittee may deem necessary in order to facilitate the safe and
efficient operation of the Swim Club.

Said subcommittee shall be comprised of the Supervisor
of the Cresskill Department of Public Works, the Pool Manager, the
Liaison to the Mayor and Council of the Borough of Cresskill and one
member of the Cresskill Municipal Pool Commission.

Any and all disbursements and expenditures incurred in connection therewith shall be approved by the Mayor and Council of the Borough of Cresskill, as per Article VI of the bylaws, and a report of such disbursements and expenditures, as well as any other actions taken by the subcommittee, shall be provided to the Cresskill Department of Public Works and the Liaison to House and Grounds Committee of the Borough of Cresskill.
