It shall be unlawful for any owner, tenant or occupant of any lot or tract of land or any part thereof in the Borough to permit or maintain on any such lot or tract of land any growth of ragweed, poison ivy, poison sumach or noxious growth injurious to health.
It shall be the duty of such owner, tenant or occupant of any such lot or tract of land or any part thereof in the Borough to cut and remove or cause to be cut and removed or otherwise destroyed all such ragweed, poison ivy, poison sumach and noxious growth injurious to health within five days after receiving notice to do so from the Board of Health of the Borough, which notice may be effected by personal service or by registered mail, return receipt requested. The redelivery by proper official authorities of the return receipt bearing the signature of the addressee shall be presumed to be proof of such notice.
Should the person upon whom such notice is served fail, neglect or refuse to cut and remove or cause to be cut and removed or otherwise destroyed such ragweed, poison ivy, poison sumach or noxious growth within five days after the service of such notice, the Borough may cause such ragweed, poison ivy, poison sumach and noxious growth to be cut and removed, and the actual cost of such cutting and removal shall be certified by the Superintendent of Public Works and Tax Collector and shall thereupon become and be a lien on the property on which ragweed, poison ivy, poison sumach and noxious growth were located and shall be added to and form part of the taxes next to be assessed on such lot or tract of land and shall be collected and enforced by the same office and in the same manner as taxes.
Any owner, tenant or occupant who shall neglect to cut and remove or otherwise destroy such ragweed, poison ivy, poison sumach and noxious growth injurious to health as directed by this Part 2, or who shall fail, neglect or refuse to comply with the provisions of any notice herein provided for, or who shall violate any of the provisions of the part, or who shall resist or obstruct the Borough or its employees in the cutting and removal of ragweed, poison ivy, poison sumach and noxious growth, upon conviction thereof before the Judge authorized to hear and determine the matter, shall be subject to a fine as provided in § 201-44 of this Part 2.
Any person violating any of the provisions of this Part 2 shall, upon conviction thereof, be fined in an amount not exceeding $500 or be imprisoned for a term not to exceed 90 days, or both. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
