[HISTORY: Adopted by the Mayor and Council of the Borough of Cresskill 1-1-1981 by Ord. No. 80-23-780 as Ch. 147 of the 1981 Code. Amendments noted where applicable.]
As used in this chapter, the following words shall have the meanings indicated:
VENDING MACHINE
Any automatic machine used for the sale of milk or other perishable food products and controlled and operated by the insertion of a coin or coins.
This chapter is for the purpose of regulation and shall not in any way affect any other fees provided for in any other provision of this Code or other ordinance of the Borough but shall be in addition thereto.
A. 
Nothing in this chapter shall be construed to apply to mechanical vending devices selling or dispensing candy, gum, cigarettes or other tobacco products.
B. 
In addition to the provisions of this chapter, all locations, plans and specifications shall be subject to the requirements of the Building Department, Chapter 275 of this Code, and all state and municipal police, fire and health regulations, codes, statutes and ordinances now or hereafter in effect.
Any person displaying for public patronage or keeping for operation any milk or perishable food product vending machine shall obtain an annual license from the Mayor and Council for any such vending machine dispensing milk or perishable products. The license fee shall be $25 for each machine operated within the Borough.
No license shall be issued unless the applicant shall first obtain from the Board of Health its written certification that the applicant has complied with all the rules and regulations established by the Board of Health with respect to the operation of such a machine.
All licenses shall be for a one-year term commencing on the first day of January of the year in which they are issued, and all licenses shall expire on the 31st day of December in the year of issue. There shall be no apportionment or abatement of the license fee for any license issued after the first day of January in any year, and the full annual license fee shall apply to any license issued during the year. The license shall expire on the 31st day of December of the same year.
All vending machines shall be identified on the outside, plainly visible, with the name and address of the licensee and the number of the license issued to such licensee.
