A. 
There shall be a Department of Fire Prevention, which shall enforce, administer and otherwise effect the provisions of the fire prevention codes, regulations and local ordinances, with emphasis on meeting the basic inspection requirements of the New Jersey Uniform Fire Code.[1]

B. 
The Department of Fire Prevention shall exist in accordance with the standards and regulations as set forth in Chapter 132 of the Code of the Township of Franklin, Somerset County, New Jersey, entitled "Fire Prevention."

The head of the Department of Fire Prevention shall be the Director of Fire Prevention, who shall also be the Fire Official for the Township of Franklin. Said Director of Fire Prevention shall be appointed by the Township Manager and shall be certified by the New Jersey Department of Community Affairs as a Fire Official.

Pursuant to Sections 15 and 17 (N.J.S.A. 52:27D-206 and 52:27D-208, respectively) of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Franklin Township Construction Board of Appeals. In the event that said Franklin Township Construction Board of Appeals is not constituted, the aggrieved person may appeal to the County Construction Board of Appeals of the County of Somerset.
