The provisions of this article shall apply except
when it is necessary to stop a vehicle to avoid conflict with other
traffic or in compliance with the directions of a police officer or
official traffic control device.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XIII (§ 195-48), attached to and made a part of this chapter.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIV (§ 195-49), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XV (§ 195-50), attached to and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XVI (§ 195-51) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.

The Chief of Police or the Chief's designee may erect and post
temporary "no parking" signs for designated days and hours for mass
gatherings or assemblies of a temporary nature, public emergencies,
and areas to provide access for emergency and fire vehicles. No person
shall park a vehicle in a designated temporary "no parking" area during
the designated times.
No person shall stop a vehicle during the times specified in Schedule XVII (§ 195-52) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVIII (§ 195-53) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XIX (§ 195-54) at any time between the hours listed in said schedule of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said schedule, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XX (§ 195-55), attached to and made a part of this chapter, except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
The locations described in Schedule XXI (§ 195-56), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XXII (§ 195-57), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXIII (§ 195-58), attached to and made a part of this chapter, are hereby designated as bus stops.
The locations described in Schedule XXIV (§ 195-59), attached to and made a part of this chapter, are hereby designated as handicapped parking areas, and only those vehicles displaying valid handicapped parking permits or valid state handicapped license plates shall park in the handicapped parking spaces designated in said Schedule XXIV.
A.
No vehicle or trailer in excess of seven feet, six
inches in height shall remain parked on any street or roadway maintained
by the Town of Poughkeepsie in excess of two hours. Height of the
vehicle shall be determined by a measurement from the roadway to the
highest point of the vehicle's body or roof, excluding any roof-mounted
lights or accessories.
B.
The following vehicles shall be exempt from this section:
(1)
Any police, fire or emergency service vehicle.
(2)
Any vehicle owned by a municipality or corporation
engaged in repairs or improvements to any service provided by the
Town of Poughkeepsie or its authorized agents.
(3)
Any vehicle owned by a municipality or corporation
engaged in repairs or improvements to any street or right-of-way maintained
by the Town of Poughkeepsie.
(4)
Vehicles rented or leased by residents or tenants
of the Town of Poughkeepsie for the purpose of moving household or
business furnishings or equipment.
A.
No vehicle shall be parked or stopped on any street,
road or highway in the Town of Poughkeepsie or in the Town of Poughkeepsie
maintained parking lot on the northeast corner of Raymond Avenue and
Main Street between the hours of 12:00 midnight and 8:00 a.m. during
the period from the first day of November to the first day of April.
B.
The provisions of this section shall not apply to
the parking of an ambulance or vehicle by a physician or surgeon on
a professional call.
A.
Findings. It is hereby declared and found that it
is vital to the public welfare of the inhabitants and visitors of
the Town that roadways and parkways in private apartment complexes
and shopping plazas be maintained in such a manner that all such areas
shall have access for emergency and fire vehicles into said areas
and that, in controlling said private roadways and areas, it will
contribute to the protection and preservation of the property of the
Town and its inhabitants' benefit and generally secure the general
welfare of the public and that the adoption of this article is within
the public interest.
B.
Authority to promulgate regulations.

(1)
The Town Board, with respect to the parking areas
and driveways of a hospital, office building or office building complex
or place of public assembly, or parking area of a shopping center
or the parking areas and driveways of facilities owned or leased by
a not-for-profit corporation or the parking areas, driveways and private
streets or roadways of a private apartment house complex, private
condominium complex or cooperative apartment complex, or the parking
areas, private streets, roadways or driveways of mobile home parks
or manufactured home parks, or the parking areas and driveways of
a fire station, or the parking areas, private streets, roadways or
driveways of an industrial park or industrial complex, or public parking
lots for railroad facilities, and pursuant to the written request
of either the owner or the person in general charge of the operation
and control of such area, the Fire Chief of the Fire Department or
the Police Chief or the Police Commissioner of the Police Department
serving such area, may, by local law or ordinance:
(a)
Order stop signs, flashing signals or yield
signs erected at entrance or exit locations to any such area or designate
any intersection in such area as a stop intersection or as a yield
intersection and order like signs or signals at one or more entrances
to such intersection.
(b)
Regulate traffic in any such area, including
regulation by means of traffic-control signals.
(d)
Prohibit or regulate the turning of vehicles
or specified types of vehicles at intersections or other designated
locations in any such area.
(e)
Regulate the crossing of any roadway in any
such area by pedestrians.
(f)
Designate any separate roadway in any such area
for one-way traffic.
(g)
Prohibit, regulate, restrict or limit the stopping,
standing or parking of vehicles in specified areas of any such area.
(h)
Designate safety zones in any such areas.
(i)
Provide for the removal and storage of vehicles
parked or abandoned in any such area during snowstorms, floods, fires
or other public emergencies, or found unattended in any such area:
(1) where they constitute an obstruction to traffic or (2) where stopping,
standing or parking is prohibited, and for the payment of reasonable
charges for such removal and storage by the owner or operator of any
such vehicle.
(j)
Adopt such additional reasonable rules and regulations
with respect to traffic and parking in any such area as local conditions
may require for the safety and convenience of the public or of the
users of any such areas.
(k)
Make special provisions with relation to stopping, standing or parking of vehicles registered pursuant to § 404-A of the Vehicle and Traffic Law or those possessing a special vehicle identification parking permit issued in accordance with § 1203A of the New York State Vehicle and Traffic Law or § 195-28 of this chapter.
(2)
In the case of a college or university, as defined
in § 2 of the Education Law, the provisions of this section
shall apply only upon the written request of the governing body of
such college or university.
C.
Application for control; power of the Chief of Police
or his or her designee. An owner of real property on which there is
a private apartment house complex, shopping center or hospital may
apply to the Chief of Police of the Town or his or her designee, in
writing, to have areas designated within such complex, center or hospital
as "No Parking," "No Standing" and "Handicapped Parking" areas. The
Chief of Police or his or her designee shall have the power to designate
such areas to provide free access to fire and emergency vehicles onto
the premises and to permit barrier-free access to the premises for
handicapped persons insofar as practicable.
D.
Appeals from determinations of the Chief of Police
or his or her designee. Whenever the Chief of Police or his or her
designee shall disapprove an application or refuse to designate "No
Parking," "No Standing" or Handicapped Parking" areas within a private
apartment house complex or shopping center or when it is claimed that
the provisions of this article do not apply or that the true intent
or meaning of this article has been misconstrued or wrongly interpreted,
the applicant may appeal from the decision of the Chief of Police
to the Town Board within 30 days from the date of the decision appealed.
E.
Signs. "No Parking," "No Standing" and "Handicapped
Parking" areas, as designated by the Chief of Police or his or her
designee, shall be properly marked with appropriate signs as required
by the Chief of Police or his or her designee. All signs shall be
at the expense of and maintained by the owners of the real property.

Except when necessary to avoid conflict with other traffic,
or when in compliance with law or the directions of a police officer
or traffic-control device, no person shall stop, stand or park a vehicle
in the Town of Poughkeepsie:
A.
On the roadway side of any vehicle stopped, standing or parked at
the edge or curb of a street; or
B.
On a sidewalk; or
C.
Within an intersection, except when permitted by official signs or
parking meters on the side of a highway opposite a street which intersects
but does not cross such highway; or
D.
On a crosswalk.

No person shall stand or park a vehicle in the Town of Poughkeepsie,
whether occupied or not, except momentarily to pick up or discharge
a passenger or passengers in front of a public or private driveway.

No motor vehicle shall be parked on the public highways of the
Town of Poughkeepsie unless a certificate or certificates of inspection
as required by New York State Vehicle and Traffic Law, Title III,
Article 5, is or are displayed upon the vehicle or affixed to the
registration certificate for the vehicle as may be determined by the
Commissioner of Motor Vehicles.

No motor vehicle shall be parked on the public highways of the
Town of Poughkeepsie unless proof of registration in accordance with
the provisions of Title IV, Article 14, of the New York State Vehicle
and Traffic Law is displayed as required by the Commissioner of Motor
Vehicles.
