Notwithstanding the truck and tractor-trailer weight and length restrictions set forth hereinabove in § 195-46B and C, the Town Supervisor may authorize the operation of trucks and tractor-trailers during hours otherwise prohibited where there are matters of an emergency nature and/or the delivery of petroleum products is required to protect the public health, safety and welfare during state, county or Town emergencies, as confirmed by the Town Supervisor. The Town Supervisor shall determine the nature, scope and temporal restrictions or limitations to be in effect during an exception period. An exception from the above restrictions in order to address matters of an emergency nature and/or heating or emergency fuel needs shall not be unreasonably withheld or denied in the event of a request by a Town resident.

The Town Board shall by resolution adopt and may thereafter amend emergency policies and procedures to implement emergency exceptions, which policies and procedures shall include a twenty-four-hour emergency contact telephone number by which the Supervisor or his/her designee may be notified of a request for an exception. The emergency policies and procedures shall require a telephone call or other responsive communication by the Supervisor or his/her designee within 30 minutes of a request for an exception.

Handicapped parking spaces as designated in the parking areas of a hospital, office building or office building complex, place of public assembly, parking area of a shopping center, parking areas of facilities owned or leased by a not-for-profit corporation, driveways and private streets or roadways of a private apartment house complex, private condominium complex or cooperative apartment complex, roadways or driveways of mobile home parks or manufactured home parks, a fire station, an industrial park or industrial complex and parking lots for railroad facilities.

§ 195-60 On-street parking permit system.

Legal authority. Notwithstanding any other applicable provisions of New York State Vehicle and Traffic Law, any other local law, order, rule or regulation, the Town Board of the Town of Poughkeepsie, New York, shall have the power and authority to adopt on-street parking permit systems for streets or portions thereof located within the territorial limits of the Town of Poughkeepsie, New York.

Purpose. The purpose of the on-street parking permit system is to exempt holders of permits from time limit and no-parking ordinances in effect in the designated districts, except for alternate side parking or parking limits which are imposed for the purposes of street cleaning, garbage and snow removal. In addition, nothing in this section shall be construed or enforced to prevent the parking of vehicles on the designated streets for the purpose of deliveries or provision of service or repairs, such as parking by telephone or utility companies, plumbers, electricians, emergency vehicles or vehicles of any governmental agency while the driver is actually engaged in business in the parking district.

Board findings. In order for the Board to determine whether an area shall be designated as an on-street parking permit district, there shall be submitted to the Board substantial evidence that five or more of the following adverse conditions exist in the subject district. Substantial evidence shall be defined to include but not be limited to neighborhood petitions, neighborhood residence surveys, citizen complaints, parking survey and traffic study.

Hazardous traffic conditions resulting from the use of streets by nonresidents of the area.

Polluted air, excessive noise, refuse and litter.

Conditions that threaten the protection, enhancement and preservation of historic, aesthetic, cultural and architectural sites of value and interest and the character of the area.

(4)

Need to promote the use of mass transit and encourage reliance on car pools.

(5)

Interference with the maintenance of streets in the district that prevents clean and safe conditions.

(6)

Property values in the area are threatened.

(7)

That the traffic safety and the safety of children and other pedestrians is affected.

(8)

The existence of dangers arising from blockage of fire lanes, hydrants and other facilities required by emergency vehicles, both in reaching victims and in transporting them to the hospital.

(9)

Unreasonable burdens in gaining access to properties.

(10)

Need to preserve the peace, good order, convenience and welfare of citizens of the Town.

(11)

Blockage of traffic movement on a regular basis or in the event of accidents and other disasters.

Permits for on-street parking districts. Permits for parking in the on-street parking permit districts, as set forth in § 195-60F shall be issued by the Town Clerk of the Town of Poughkeepsie. Such permits shall be available in the following categories:

Town residents.

Permits shall be issued to Town of Poughkeepsie residents who meet the following requirements:

Sign an application form providing his/her residence address in the Town, the license plate number and description of the vehicle to be permitted and the on-street parking district for which the permit is requested.

Exhibit proof of Town residency in one of the following forms: a valid New York State driver's license indicating Town residence; or valid tax receipt for current year for taxable property within the Town; or valid voter registration card indicating applicant's place of residency in the Town; or current utility bill indicating place of residency in the Town.

Exhibit a valid, current vehicle registration for the vehicle for which a permit is sought in the name of the applicant or a family member with whom the applicant resides, and indicating the Town residence if required by New York State Motor Vehicle and Traffic Law.

Permits shall be issued to Town residents at no annual fee.[1]

Editor's Note: Pursuant to L.L. 13-2021, adopted 11-3-2021, effective 1-1-2022, all fees will be in a Fee Schedule maintained in the Town offices, which fees may be amended from time to time by resolution.

One permit per applicant shall be issued, and up to two permits per residential dwelling unit that has been established according to Town records shall be issued. These permits shall include two guest permits which will not be registered to a particular vehicle.

Nontown residents.

This permit shall be issued to persons who do not qualify for resident permits pursuant to § 195-60D(1).

Permits shall be issued to nontown residents at an annual fee of $250.[2]

The applicant shall be required to submit an application form, which shall require the applicant to provide the registration and license plate number and description of the vehicle to be permitted, the on-street parking district for which the permit is to be requested and submit for inspection the vehicle registration in the applicant's name.

Owners and lessees of commercial, retail, industrial, office or other nonresidential property within the Town boundaries.

One permit per applicant, and up to two permits per commercial, retail, industrial, office or other nonresidential unit at the property, that has been legally established according to Town records, for use by the owner, lessee or employees thereof, shall be issued.

Owners or lessees shall be required to submit an application form and provide the registration and license plate number and description of the vehicle(s) to be permitted, the district for which the permit is requested and submit for inspection one of the following: a valid tax receipt stub for the current year for the taxable property within the Town boundaries or a current utility bill for the property within the Town boundaries indicating the name of the applicant.

Owners and lessees of commercial, retail, industrial, office or other nonresidential property within the Town boundaries shall pay the same fee as established for Town residents.

Owners or lessees of nontaxable property located within the Town.

One permit per applicant, and up to two permits per nontaxable property or other nonresidential unit at the property, that has been legally established according to Town records, for use by the owner, lessee, or employees thereof, shall be issued.

Owners or lessees shall be required to submit an application form and provide the registration and license plate number and description of the vehicle(s) to be permitted, the district for which the permit is requested and submit for inspection one of the following: proof of ownership of the property or a current utility bill for the property within the Town boundaries indicating the name of the applicant.

Owners and lessees of nontaxable property located in the Town shall be required to pay the same annual fee as established for nontown residents.

Rules and regulations.

Permits shall be issued by the Town Clerk for the Town of Poughkeepsie.

Permits shall be issued for only one on-street parking district as requested by the applicant at the time of the issuance of the permit. Residents seeking a permit for more than one district shall be required to pay the annual fee as established for nonresidents for each additional district permit requested.

(3)

Issuance of a permit pursuant to the provisions of this section shall not guarantee an available on-street parking space in the district. Parking shall be provided based upon availability only.

(4)

Permits shall be promptly displayed in a manner directed by the Town Clerk in the vehicle for which the permit is issued.

(5)

Permits shall be issued on an annual basis only, for the period January 1 to December 31 of each year, and must be renewed each year. No prorated annual charge or refunds shall be available.

(6)

Permits are nontransferrable and may be utilized only in the vehicle identified in the permit application and for which the permit was originally issued, unless written approval has been obtained from the Town Clerk transferring the permit to a different vehicle.

(7)

Permits shall enable the holder to park a vehicle on a street within the district for which the permit was issued without being subject to the time limit parking or no parking in effect on the street, except for parking limits imposed to facilitate street cleaning, garbage and snow removal as described in § 195-60B.

(8)

All fees collected shall be credited to the general fund of the Town.

On-street parking districts.

The following on-street parking districts are hereby created:

District 1: Saint Francis Hospital.
