For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
ASHES
The residue from the burning of wood, coal, coke and other combustible materials for the purposes of heating and cooking. It shall not include the cinders produced in steam-generating plants.
BUILDING RUBBLE
The waste material resulting from the construction or demolition of buildings or roads, tree trunks and limbs and other similar material.
COLLECTOR
A person licensed to transport refuse for others as provided in this chapter.
CONTRACTOR
A person engaged in the business of construction, repair or demolition of buildings under a building permit issued by the Township.
GARBAGE
The animal and vegetable waste resulting from the handling, preparation, cooking and consumption of foods. It shall not include food-processing wastes from canneries, packing plants or similar industries nor large quantities of condemned food products.
HEALTH DEPARTMENT
The Department of Public Health of the Township or any duly authorized representative of the Department of Public Health.
POLICE DEPARTMENT
The Police Department of the Township or any duly authorized representative of the Police Department.
REFUSE
Garbage, ashes, rubbish and building rubble as herein defined.
RUBBISH
All waste materials not included in "garbage" and "ashes," except large dead animals, large machinery or vehicles or such other waste materials as are not commonly produced in homes, stores and institutions.
The collection and removal of garbage, ashes and rubbish shall be done in accordance with the provisions of this chapter, shall be subject to the general supervision of the Department of Public Health and Police Department and shall be subject to such additional rules and regulations as those Departments may from time to time prescribe not inconsistent with the provisions of this chapter.

It shall be unlawful for any person to keep in or about any dwelling or upon any land or other premises within the Township any garbage or any refuse of any kind which is obnoxious or offensive by reason of dust or odor or which attracts insects and vermin, except in covered receptacles. The cover shall be tight and flyproof. No receptacles in which refuse is contained shall, when filled, exceed 50 pounds in weight.
It shall be unlawful for any person to retain, accumulate or to permit the accumulation of any refuse in excess of one week. Nothing herein contained shall be construed to permit the retention of any refuse which is or becomes obnoxious or offensive by reason of dust or odor or which attracts insects and vermin.
It shall be unlawful for any person to permit the removal from premises owned or occupied by him of any refuse produced on such premises except in accordance with the preceding section or by a refuse collector duly licensed by the Township as hereinafter set forth.
Receptacles for garbage shall be of a type designed by the manufacturer sufficiently strong for the purpose and may be pails or cans with a capacity of not less than 2 1/2 nor more than 20 gallons. They shall be watertight and shall have close-fitting covers, and said receptacles shall be kept covered, except when opened for the filling or emptying of material.
Receptacles for ashes shall be boxes, cans or small barrels that can be handled by one man, of a size not to hold more than 100 pounds of coal ashes, and shall be sufficiently tight to prevent leakage of ashes through the container. Receptacles for rubbish, other than paper, shall be strong boxes, baskets or barrels in which it is conveniently possible to place such rubbish.

All receptacles for garbage, ashes or rubbish and all bundles of wastepaper shall be set by the occupant on the sidewalk or street line in front of the premises at the curb, or, if a private arrangement is made between the occupant and the collector, they may be set at the rear or side of the building, or the collector may remove them from within the premises in accordance with such private arrangements between the occupant and the collector. The garbage receptacles must be placed at curbside the evening preceding scheduled trash pickup. The garbage receptacles shall be removed no later than the evening following the trash pickup.
The occupant shall keep all receptacles clean and in a proper condition for safe handling. In buildings in which two or more families reside, each family shall make its own receptacles with the initials of the respective name, so as to render the receptacles readily identifiable. Immediately after receptacles are properly emptied, the collector shall return them to the point from which he took them.

A. 
No person shall dump, throw, discard or abandon, or cause the same to be done, any garbage, rubbish, junk or any other refuse material on any lands or premises in the Township, except in a sanitary landfill.
B. 
The accumulation or burying of refuse upon any premises within the Township, except in a sanitary landfill of the Township, is declared to be a nuisance and is prohibited.
C. 
Should the violation be of such a nature as to be evidenced or deemed to constitute a hazard to public health or safety, the municipality may elect to contract for the necessary removal of garbage, rubbish, junk or refuse material. The cost of investigating, administering and removing of same shall be assessed against the property and shall become a lien and a tax on said property and be added to and be a part of the taxes to be levied and assessed thereof and enforced and collected with interest in the same manner as other taxes. The Township may elect to foreclose on the properties of repeat violators and the proceeds used to maintain said property.
All free liquids shall be drained from refuse before it is placed in receptacles for collection. Garbage shall be wrapped in paper. All cans and bottles which have contained food shall be thoroughly rinsed and drained before being deposited for collection.
Tree trimmings, hedge clippings, grass clippings and similar material shall be cut to a length not to exceed four feet and shall be disposed of in neat tied bundles or in disposable containers, including but not limited to bags and boxes.
The transporting of refuse into the Township from without the boundaries of the Township for the purpose of accumulating, burying, burning or destroying such refuse within the Township or to dump at the landfill is prohibited.

It is the intent of this chapter to adopt as a portion of this chapter Subchapter 1 and Subchapter 3 of the Solid Waste Code of New Jersey (1996). Such code is made a part hereof without the inclusion of the text thereof herein. Should there be any conflict between this chapter and the Solid Waste Code as adopted here, the provisions of this chapter shall rule.

A. 
No person shall throw, cast, deposit, drop, scatter or leave or cause to be thrown, cast, laid, deposited, scattered or left in or upon any street, alley, sidewalks, parking or other public place in the Township or upon any private property not owned by such person any coal, ash, dirt, trash, garbage, gravel, sand, sawdust, shavings, hay, straw, leaves, offal, vegetable matter of any kind, deal animals or putrescible matter of any kind or building materials of any kind.
B. 
This section shall not be deemed to apply to the placing of any material upon a public place or road, etc., for the purpose of achieving traction in weather conditions of snow and ice.
C. 
Distribution of commercial advertising and unsolicited newspapers. No person shall throw, cast, deposit, drop, scatter or leave or cause to be thrown, cast, laid, deposited, scattered or left any commercial advertising, unsolicited newspaper or advertising tabloids:
(1) 
In or upon any private premises which are temporarily or continuously uninhabited or vacant;
(2) 
In or upon any vehicle;
(3) 
In or upon the private premises, which are inhabited, except by handling or transmitting same directly to the owner, occupant, or other person then present except as hereinafter, provided that a person, unless requested by anyone upon the premises not to do so, may place or deposit any such commercial advertising, unsolicited newspaper, or advertising tabloid in or upon inhabited premises if the premises are not posted as provided in this section and the commercial advertising, unsolicited newspaper or advertising tabloid is placed or deposited as to secure prevention from being blown or drifted about the premises of sidewalks, streets or other public places. Mailboxes may not be used when prohibited by federal postal rules or regulations. This provision of this section shall not apply to the distribution of mail by the United States nor to newspapers.
D. 
Distribution of commercial matter, unsolicited newspapers or advertising tabloids where refused or sign posted. No person shall throw, deposit, distribute or cause to be thrown, deposited and distributed any commercial advertising, unsolicited newspapers or advertising tabloid in or upon any premises if requested by anyone in or upon such premises not to do so or if there is placed on such premises in a conspicuous position near the entrance thereof a sign bearing the words: "No Trespassing," "No Peddlers or Agents," "No Advertisement" or any similar notice indicating that the occupants of the premises do not desire to have their right of privacy disturbed or to have any such matter left upon the premises.
