[HISTORY: Adopted by the Township Council of the Township of Franklin 11-10-1992 by Ord. No. 1743 (Ch. 226 of the 1990 Code). Amendments noted where applicable.]
A. 
Words and phrases. Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
B. 
Official time standard. Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use.
A. 
The Director of the Department of Public Safety or, in his absence, disability or inability to act, the Chief of Police of the municipality, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
B. 
Any regulations promulgated by the Director of the Department of Public Safety and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
D. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
Any vehicle parking in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided in New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to penalties in compliance with state surcharges or imprisonment for a term not exceeding 15 days, or both.
If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.
All former traffic ordinances of the Township of Franklin, Somerset County, are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
A. 
Upon the declaration of any emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs. The effectiveness of this subsection is continent upon the signs being erected as required by law.
B. 
The Director of Public Safety or the Chief of Police or, in his absence, the ranking police officer, is also empowered to suspend temporarily any prohibition against parking when weather conditions, accidents, road construction, fire, public celebrations or other sudden or unusual conditions dictate or require such suspension to avoid interference with the free flow of traffic. In such instances, all signs prohibiting parking in such areas shall be covered or otherwise obscured.

A. 
Removal.
(1) 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on either side of any street in the Township. This prohibition is applicable whether or not a no parking/snow emergency sign is posted on any street.
(2) 
The parking prohibition in Subsection A(1) of this section shall remain in effect after the snow has ceased, until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
B. 
Posting of signs.
(1) 
No parking/snow emergency signs shall be posted on all main entrances to the Township of Franklin on all state, county and local roads, together with such other locations as are set forth below. The lack of such sign on any particular street in the Township of Franklin shall not be construed to mean that parking is permitted during snow emergencies.
(a) 
Signs reading "No Parking On Any Street When Snow Covered," at least 18 inches by 24 inches in size shall be posted at the main entrances to the Township of Franklin.
(2) 
Notification that the emergency no parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

C. 
Exemptions.
(1) 
Exempt streets (parking where permitted).
The following streets are exempt from the provisions of § 226-9A:
(a) 
Brookline Avenue.
(b) 
Home Street.
(c) 
Ambrose Street.
(d) 
Philips Road.
(2) 
Individual property parking exemption permit.
(a) 
Where a property does not have any off-street parking or a Township-designated parking area, a snow parking permit can be applied for at the Department of Public Works.

A Police Department Traffic Officer will inspect the property and will advise the Director whether the issuance of the permit is valid.
(b) 
The snow parking permit is no charge.
(c) 
Placement of sticker. The seasonal sticker, issued by the Department of Public Works, must be visibly placed based on the Police Department's designated location for each approved vehicle.
(d) 
Vehicles which park on the listed exempted streets do not require a permit.
D. 
Removal of vehicles. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

A. 
Definitions.
RECREATIONAL VEHICLE
A vehicle which is designed primarily to transport a person for primarily recreational instead of transportation purposes, or a vehicle that serves as a mobile, temporary dwelling. This may include a vehicle that is self-propelled, towed or carried by another vehicle, but shall not include camper caps that fit over pickup trucks. This term shall also include the following: watercraft, motor homes, travel trailers, all-terrain vehicles and snowmobiles.
B. 
It shall be unlawful for any person to park the following described vehicles upon any streets in the Township between the hours of 12:00 midnight and 6:00 a.m. on any day.
(1) 
Any vehicle with a gross vehicle weight rating of 12,500 pounds, any trailer or semitrailer, or any omnibus.
(2) 
All recreation vehicles, boat trailers, utility trailers, landscaping trailers or any other type of trailer requiring a New Jersey Motor Vehicle Commission registration plate, whether such registration plates are considered private or commercial.
(3) 
Any unattached trailer regardless of the status of the registration.

E. 
Signs, pavement markings: installation and maintenance.
(1) 
Signs, designed pursuant to state statute and any regulations promulgated pursuant thereto, shall be erected adjacent to the parking spaces indicated in § 226-30C and D to carry out the provisions of this section.
(2) 
Installation, maintenance and replacement of signs designating handicapped parking spaces on private property shall be the responsibility of the property owner or homeowners' association. Private property includes but is not limited to industrial, commercial, multifamily and single-family residences and condominiums.
(3) 
The Police Department shall notify any property owner of a handicapped parking sign which is in a state of disrepair and/or in need of replacement. The property owner shall have 30 days to repair or replace such sign. Failure to carry out such repair or replacement as required shall constitute a violation of this section.
F. 
Violations and penalties. Any person, firm or corporation who shall violate any provision of this section shall, upon conviction therefor, be fined $250 for the first offense and, for subsequent offenses, be fined at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate. Every day that a violation continues after due notice has been served shall be deemed a separate offense.

A. 
Regulation for the movement and parking of traffic on municipal and Board of Education property.

(1) 
Pursuant to the authority granted by N.J.S.A. 40:48-2.46, no person shall park or operate a vehicle within the Municipal Complex, 475 DeMott Lane, Somerset, NJ, and Board of Education property except in accordance with Site Plan of such complex on file with the Township Clerk.
(a) 
Municipal Complex.
[1] 
Parking. All vehicles must park only in designated areas and between the lines provided.
[2] 
Through streets. The following streets or parts of streets are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street.

A. 
Adoption of Manual on Uniform Traffic Control Devices for streets and highways.
(1) 
The Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
(2) 
The Township of Franklin in the County of Somerset and State of New Jersey does hereby adopt the current Manual of Uniform Traffic Control Devices, hereafter known as MUTCD, except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of MUTCD while performing such work is in violation of this section.
B. 
Preconstruction meetings.
(1) 
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the roadway to contact the Traffic Safety Bureau of the Franklin Township Police Department in order to arrange a preconstruction meeting to submit plans for the safe movement of traffic during such period of construction work. Preconstruction meetings must be scheduled far enough in advance (a minimum of two weeks) of the desired start date so as to allow for efficient planning.
(2) 
Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Traffic Safety Bureau of the Police Department is in violation of this section.
C. 
Hazardous conditions. The person, contractor or utility shall provide the Traffic Safety Bureau of the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contract person does not respond in a timely manner to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous conditions. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor or utility responsible for such conditions.
D. 
Hours. There shall be no construction, maintenance operations or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 3:30 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 3:30 p.m. by the officer in charge of the Traffic Safety Bureau of the Franklin Township Police Department if it is determined by that officer that the construction or maintenance operations prior to 9:00 a.m. or after 3:30 p.m. would not substantially delay traffic or cause a safety or health hazard.
E. 
Road closing and detours. Road closing and/or traffic detours shall not be permitted unless approved by the officer in charge of the Traffic Safety Bureau of the Police Department. Advance notice of detours must be given to motorists, except in emergent circumstances.
F. 
Traffic directors. Any person, contractor, or in the case of a public utility as required under the public utility agreement (other than municipal, county or state employees), wishing to conduct work on, above or below any of the roads listed in Table 1; is working within 200 feet of an intersection of any road within the Township; is working in the vicinity of specific geographic features (e.g., sharp curves, alongside of rivers, steep embankments, etc.); is working within 1,000 feet of a Franklin Township Board of Education property; and/or diverts or interrupts motor vehicle or pedestrian traffic flow shall be required to hire off-duty Franklin Township police officers or traffic directors to ensure compliance with the MUTCD as well as to control traffic traveling through the work zone. The Professional Services Division of the Franklin Township Police Department shall be contacted at least 48 hours before starting work to arrange for the hiring of off-duty officers if needed. The number of officers or traffic directors required shall be determined by the Traffic Safety Bureau of the Police Department and approved by the Chief of Police. For all work on roads listed in Table 1 attached, traffic control shall be by off-duty Franklin Township police officers. The requirement to hire off-duty officers for work on, above, below, or adjacent to the roads listed in Table 1 shall only apply to work that will take in excess of one hour to complete. All work on, above, below, or adjacent to the roads listed in Table 1 taking less than one hour, or taking place on roads other than those listed in Table 1, may be controlled with traffic directors, unless off-duty Franklin Township police officers are deemed necessary by the Traffic Safety Bureau and approved by the Chief of Police. All civilian flagmen must wear lime green glow-type traffic vests and must be educated as to the proper operation of traffic flag controls. If flagmen cannot see each other, they must have walkie-talkie communication between them. In the event that work requires any road to be closed to traffic 24 hours a day, the hiring of off-duty Franklin Township police officers will be required when it is deemed necessary by the Traffic Safety Bureau and approved by the Chief of Police.

G. 
Stop work. The Police Department Traffic Safety Bureau shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.
H. 
Site preparation and maintenance. It is to be expressly understood that no materials, vehicles or equipment are to be placed in roadway or sidewalk area until all construction, signs, lights, devices and pavement markings are installed. All construction signs which do not currently apply must be bagged or removed from view of the motorists (i.e., Flagman Ahead signs after workmen have finished for the day).
I. 
Violations and penalties.
(1) 
Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof, for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days; for a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the county jail for a term not exceeding 90 days.
(2) 
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

A. 
Rules and regulations.
(1) 
Resident parking permit restrictions shall be authorized on streets where there has been demonstrated an ongoing, excessive and daily problem which creates a hardship and public safety issues for residents of a municipal street. "Ongoing," "excessive" and "daily" shall be defined to mean that a problem is occurring every day, not just weekly, monthly or periodically.
(a) 
The purpose of a permit parking program is to:
[1] 
Address a critical parking problem that creates a public safety hazard.
[2] 
Establish a residential parking program in those areas of the Township in order to facilitate and make more convenient parking within the Township for persons who reside in those residential areas.
[3] 
Protect residential areas from excessive noise, trash and refuse caused by the entry of vehicles from outside that residential neighborhood.
[4] 
Protect residents from unreasonable burdens in gaining access to their residences.
(b) 
The establishment of a resident permit parking zone shall be upon the advice of the Chief of Police or his designee, who shall be responsible for investigating whether or not the area warrants the requested restrictions.
(2) 
A resident parking permit of a design specified by the Township will be issued to residents of Franklin who own or lease a motor vehicle.
(3) 
Application for parking permits shall be made on a form by the Township. Proof of residency of the owner or lessee of a vehicle must be presented when applying for a permit.
(a) 
The following is proof of residency:
[1] 
A copy of a valid New Jersey driver's license, reflecting an address on a street upon which the permit parking restrictions are imposed in the Township of Franklin; and
[2] 
A copy of a valid New Jersey motor vehicle registration for which the permit is sought showing an address on a street upon which the permit parking restrictions are imposed.
(b) 
In the case of a vehicle claimed to be leased and used by a Franklin resident, a copy of the automobile lease shall be presented to the Township in lieu of the New Jersey motor vehicle registration. Completed applications shall be submitted to the Franklin Township Police Department Traffic Safety Bureau. Applications submitted without a copy of a driver's license and vehicle registration or lease shall be not processed.
(4) 
Permit applications shall be available at the Franklin Township Police Department at any time during the current year. Renewals may be completed beginning November 1.
(5) 
The resident's sticker is to be placed on the rear window on the driver's side in the lower left corner of the vehicle it is issued to.
(6) 
There shall be no cost for the permits.
(7) 
There shall be no visitor permits issued.
(8) 
The sale of a permit is prohibited. Permits are only valid for the vehicle they are issued to and the street/location they are issued for.
B. 
Abuse of permit. Resident permits are subject to revocation for the following:
(1) 
If any such permit is used on any vehicle that it is not registered to under this section.
(2) 
Willfully providing any false or inaccurate information for the purpose of obtaining a permit hereunder.
C. 
Term of permits. Resident permits shall expire annually on December 31. Any vehicle bearing an expired resident permit and parked on a street posted as "Permit Only" shall be subject to the same penalty as a vehicle parked on the street without a resident permit as set forth in Subsection E.
D. 
Exemptions. The prohibition set forth in Subsection G shall not apply to the following:
(1) 
Contractor/service and delivery vehicles. Contractor, service and delivery vehicles bearing the name and address of a commercial business may park adjacent to the residential premises where they are working without permit during the times they are rendering service.
(2) 
Emergency and utility vehicles. Emergency vehicles, municipal vehicles, gas, electric, telecommunications and other similar vehicles may park within the Township during times they are rendering service or repairs within the Township.
(3) 
Health care providers may park their vehicles within the Township during the times they are rendering assistance or healthcare service to residents of the Township. "Health care provider" is defined as a nurse, home health aid, physical therapist or any other medical professional.
(4) 
Handicapped parking: any motor vehicle identified and registered for a handicapped driver by the New Jersey Motor Vehicle Commission and displaying the required handicapped plates or placards.
E. 
Violations and penalties.
(1) 
Any vehicle parked on a street posted "Permit Parking Only" without a valid resident permit shall be subject to a parking fine in the amount of $25.
(2) 
Any violation of Subsection B above shall be result in the offending person being subject to a fine in an amount up to $250 for a first offense and $500 for each subsequent offense thereafter.
(3) 
The Franklin Township Police Department may remove and impound any vehicles which are parked in violation of this article. The cost of said removal shall be borne by the vehicle owner or lessee.
F. 
Enforcement.
(1) 
The Franklin Township Police Department shall have the authority to issue summonses for violations of this section.
(2) 
Enforcement of this section shall be under the jurisdiction of either the Franklin Township Police Department and/or Chief of Police of the Franklin Township Police Department.
G. 
Resident permit parking only at certain times on certain streets. No person shall park or cause to be parked any vehicle on streets or parts of streets as described within the following sections unless an appropriate and current parking permit issued by the Township of Franklin is displayed on said vehicle for those streets or parts of streets as described or listed with the following sections.

C. 
Meadow Avenue.

(1) 
A fifty-foot-wide road beginning at its intersection with Bennington Parkway (formerly known as "Franklin Parkway") and extending southwesterly, along its various courses, a distance of approximately 714 feet to its terminus. The above-named road as laid out on a certain map entitled, "Franklin Park Farms, Situated in Franklin Park, Twp. of Franklin, Somerset Co., N.J.," prepared by John J. Kentz, C.E. and Surveyor, Summit, N.J., dated October 1930, and filed in the Somerset County Clerk's office on February 4, 1931, as Filed Map No. 136A.
(2) 
Notice of the closing shall be posted at the points of the closed section of the roadway and a barricade erected at those points.
(3) 
In accordance with the provisions of N.J.S.A. 39:4-94.2, no person shall drive a vehicle on or over the closed portion of the roadway.

A. 
Publicly accessible EVSE, located on municipally owned properties, shall be reserved for parking and charging electric vehicles only. Electric vehicles shall be connected to the EVSE.
B. 
Pursuant to N.J.S.A. 40:48-2, publicly accessible EVSE parking spaces, located on municipally owned properties, shall be monitored by the municipality's Police Department and enforced in the same manner as any other parking. It shall be a violation of this section to park or stand a nonelectric vehicle in such a space, or to park an electric vehicle in such a space when it is not connected to the EVSE. Any nonelectric vehicle parked or standing in a EVSE parking space or any electric vehicle parked and not connected to the EVSE shall be is subject to fine and/or impoundment of the offending vehicle as described in the general penalty provisions of this Municipal Code. Signage indicating the penalties for violations shall comply with Subsection C below. Any vehicle parked in such a space shall make the appropriate payment for the space and observe the time limit for the underlying parking area, if applicable.
C. 
Signs.
(1) 
EVSE shall have posted regulatory signs, as identified in this section, allowing only charging electric vehicles to park in such spaces. For purposes of this section, "charging" means that an electric vehicle is parked at an EVSE and is connected to the EVSE. If time limits or vehicle removal provisions are to be enforced, regulatory signs, including parking restrictions, shall be installed immediately adjacent to and visible from the EVSE.
(2) 
All regulatory signs shall comply with visibility, legibility, size, shape, color, and reflectivity requirements contained within the Federal Manual on Uniform Traffic Control Devices as published by the Federal Highway Administration.
(3) 
In addition to the signage described above, the following information shall be available on the EVSE or posted at or adjacent to all publicly accessible EVSE parking spaces: hour of operations and/or time limits if time limits or tow-away provisions are to be enforced by the municipality; usage fees and parking fees, if applicable; and contact information (telephone number) for reporting when the equipment is not operating or other problems.
