The short title by which this article shall be known is the "Christmas Sales Ordinance."

The sale of trees, wreaths, sprays and other similar decorations used during the Christmas season in A, RR5, RR3, CP, NB, OP, G-B, M-1 and M-2 Zones within the Township, including authorization to utilize a temporary shed, trailer or like structure during the period of sale to provide shelter for those conducting the sale, shall require a temporary permit from the Township Code Department, after a firesafety inspection of the proposed sale site. Such sale in other zones of the Township is strictly prohibited.
Premises used throughout the year for the sale of trees, shrubbery, plants, farm produce and other similar landscaping or agricultural products shall not be subject to this article's permit requirement.
The maximum allowable time period for said sale shall be from November 1 to December 31 and from 6:00 a.m. to 1:00 a.m. on any given day therein.
No such permit shall be construed to relieve any applicant therefor of the duty to properly store and maintain said trees in order to not endanger property or interfere with the operation of the Police or Fire Department or the egress of occupants of the premises in case of fire or to comply with any applicable provisions of this Code.

Any sign used in conjunction with the sales regulated by this article shall measure a maximum of four by eight feet (32 square feet), shall be limited to eight feet in height and shall be no more than two in number. Any such sign shall be located at least 10 feet back from the property line of the premises used for such sale and shall not be erected within any sight triangle and shall comply with all other requirements of applicable ordinances not inconsistent herewith.
Any triangular area formed by two intersecting streets or highways, measuring 100 feet from the point of intersection in the case of county roads and state roads or 30 feet from the point of intersection in the case of local roads (the greater of the required distances when two roads of different distance requirements intersect), shall be free of visual obstructions measuring more than three feet in height caused by Christmas sales as defined in this article.
Any violation of the provisions of this article shall be punishable as provided in Chapter 1, Article II, General Penalty.
