A. 
No person shall operate any taxicab within the Township unless both the taxicab and the driver thereof are licensed pursuant to this article and conform to all the provisions hereof.
B. 
Violating this provision shall result in a penalty assigned to the taxicab driver and the taxicab owner as provided in Chapter 1, Article II, General Penalty. Any sworn law enforcement officer may enforce this section. Upon conviction in Municipal Court, the Township Clerk may refuse to grant a taxicab owner's license for a period up to one year, if an application is made.
There are hereby established two classes of taxicab licenses to be known as "taxicab driver's license" and "taxicab owner's license," respectively.
Applicants for a taxicab driver or owner's license must have had a drug screening conducted within 30 days of their application and must submit the results of the drug test to the Township Clerk. This drug test must have been performed by a facility duly licensed to conduct drug testing by the State of New Jersey, and shall screen for all illegal substances. Failure to submit drug-testing results, or to have failed a drug test, will result in the rejection and/or denial of the application.
All applications for the issuance or renewal of any license of either class shall be made to the Township Clerk on forms adopted by and obtained from the Township Clerk, which forms shall be designed to elicit information respecting the identification, responsibility and law-abiding habits of the applicant. An applicant, after a background investigation, can be disqualified if convicted of offenses as per state statute.
Each applicant for a license of any class shall supply the information requested on the application in full and verify the correctness thereof by his oath or affirmation and thereafter file the completed application with the Township Clerk, together with the full amount of the proper fee hereafter fixed therefor. The Clerk shall issue or renew or deny the issuance or renewal of such license within 30 days of the day application for the same was filed with the Clerk. Failure by the Clerk to act on the application within the aforesaid thirty-day period may be deemed by the applicant as a denial of the same.
The Township Clerk shall, at the time a final decision is rendered on any application, pay the fees received therefor over to the Township Treasurer.
Any license issued pursuant to the terms of this article shall expire at 12:00 midnight on the 31st day of March of the year next following issuance, unless sooner surrendered, suspended or revoked.
A taxicab owner's license shall entitle the taxicab therein described to be operated in the Township by a driver duly licensed hereunder until the license either expires or is surrendered, suspended or revoked.
A. 
Every applicant for a taxicab owner's license shall, together with his/her application, submit to the Township Clerk a certificate of insurance, naming the Township of Franklin, care of the Township Clerk, as certificate holder, by a company duly licensed to transact business under the insurance laws of the State of New Jersey, and any amendments thereto, insuring the vehicles for the following minimal coverage amounts: $250,000 to satisfy all claims for damages, by reason of bodily injury to, or the death of, any one person, resulting from an accident, and a sum of not less the $300,000 to satisfy all claims for damages, by reason of the bodily injuries to, or the death of all persons, on account of any such accident by reason of the ownership, operation, maintenance, or use of such taxicab upon any public street; and conditioned for the payment of a sum of not less than $100,000 to satisfy all claims for damages to property of all persons resulting from an accident by reason of the ownership, operation, maintenance, or use of such taxicab upon any public street.
B. 
In the event that the applicant's insurance company does not issue split levels of insurance coverage, a combined single-limit coverage may be used. This single limit may not amount to less than $300,000 to satisfy all claims for damages by reason of bodily injury or death, and/or property damage resulting from the ownership, operation, maintenance, or use of such taxicab upon any public street.
A taxicab driver's license shall entitle the person named therein to operate within the Township any taxicab duly licensed hereunder until the license either expires or is surrendered, suspended or revoked, and it shall not be transferable.
Each applicant for a taxicab driver's license shall file with his application two photographs, each one inch by one inch in size, clearly depicting the facial features of the applicant, both of which photographs shall have been taken within one year prior to the application for the taxicab license, and which shall thereupon become the property of the Township and be retained with the application form. Upon granting of the application, one of such photographs shall be permanently affixed to the license card in a space provided thereon.
Every applicant for a taxicab driver's license or taxicab owner's license shall, at the time of filing his initial application, be fingerprinted by the Police Department. After a license has been issued, the license holder may thereafter annually elect to be refingerprinted or to supply to the Police Department an executed New Jersey State Police, Bureau of Identification Request for Criminal History Record Information Form, provided the license holder is refingerprinted at least once in any five-year period. An impression of such fingerprints shall thereupon be forwarded forthwith by the Police Department to the Bureau of Identification of the New Jersey State Police for a report of the applicant's criminal record, which report when received shall be permanently maintained by the Police Department. The fee for such fingerprinting and report and Bureau of Identification Request for Criminal History Record Information Form shall be $5, payable to the Franklin Township Police Department plus any applicable fee charged by the State Police.

Each applicant granted a taxicab driver's license shall be issued a license card in evidence thereof signed by the Township Clerk. Such license card shall at all times be prominently displayed and adequately protected in the interior of any taxicab operated by the licensee so that the face thereof shall be at all times in the full view of and plainly legible to any passenger seated in the rear seat of such taxicab. The license card shall at all times be and remain the property of the Township and shall at any time be surrendered to the Township Clerk.
B. 
Violating this provision shall result in a penalty assigned to the taxicab driver as provided in § 350-7. Any sworn law enforcement officer may enforce this section. Upon conviction in Municipal Court, the Township Clerk may suspend the taxicab driver's license for a period of seven to 30 days.
The applicant for a taxicab driver's license shall cause himself to be examined by a reputable doctor licensed to practice medicine in the state and shall file with his application for the issuance or renewal of a driver's license a certificate of such doctor, dated within 30 days of filing, showing that the applicant is in good general health, free of any communicable disease and has no past history of epilepsy, coronary thrombosis, cerebral hemorrhage or other affliction which might cause sudden loss of control of a taxicab and eyesight corrected to 20/20 with glasses.

No taxicab driver's license card other than that of the licensee actually operating the cab at the time shall be displayed therein.
B. 
Violating this provision shall result in a penalty assigned to the taxicab driver as provided in § 350-7. Any sworn law enforcement officer may enforce this section. Upon conviction in Municipal Court, the Township Clerk may suspend the taxicab driver's license for a period of seven to 30 days.
A. 
Applicants for a taxicab driver's or owner's license must, at time of application, provide a certified abstract from the New Jersey Department of Motor Vehicles detailing the applicants' previous five years of driving history. Applicants who do not have five years worth of driving experience within New Jersey must provide a certified abstract from the state in which they were previously licensed, or an affidavit explaining their lack of five years of driving experience.
B. 
Failure to submit a required abstract shall result in the rejection and/or denial of the application by the Township Clerk.

All applicants for a taxicab driver's license must possess a valid New Jersey driver's license prior to application being made.
B. 
Failure to meet the requirement of this section shall result in the rejection and/or denial of the application by the Township Clerk.
