[Adopted 12-31-2001 by Ord. No. 2001-37 as § 19-6.10 of the 2001 Code]
As used in this article, the following terms shall have the meanings indicated:
BUILDING MATERIALS
Any material such as lumber, brick, plaster, gutters, roofing shingles or other substances accumulated as a result of repairs or additions to or the demolition of existing structures, or construction of new structures.

BULK ITEMS
Large single items such as, but not limited to, furniture, mattresses, box springs, household articles of an unwieldy nature, containers and other such waste usually disposed of by households.

BUNDLE
A collection of normally loose items that are tied with twine. A bundle shall not measure more than four feet in length and shall not exceed 50 pounds in weight. Bundles shall be placed for municipal collection so as to be conveniently handled by one person.

GARBAGE
The refuse or residue of animal or vegetable matter that has been used as food and all refuse, animal or vegetable matter, including carcasses and parts of dead animals. It shall include fowl, manure, decayed vegetables fruit, or any condemned food.
HOME REPAIR DEBRIS
Any waste building materials and/or debris resulting from construction, remodeling, repair or demolition operations performed by a resident.

MUNICIPAL COLLECTION
The collection of garbage, rubbish, nonrecyclable paper, home repair debris, and trade wastes by or on behalf of the Township from residential properties.

NONRECYCLABLE PAPER
Shredded paper, coated paper, and cardboard.

RUBBISH
All miscellaneous matter and bulk items, such as rags, old clothes, shoes, broken glass, leather, carpets, crockery, rubber, cut grass, or lumber.

TRADE WASTES
All materials resulting from any home-based business, trade, or industry.

A. 
Highways; private and public property. No person shall deposit or throw garbage, rubbish, nonrecyclable paper, home repair debris, or trade waste on or along any public or private highway, road, or street within the Township or on any public or private property.[1]

B. 
Streams or bodies of water. No person shall deposit or throw garbage, rubbish, nonrecyclable paper, home repair debris,or trade waste in any lake, stream, or body of water within the Township.

Garbage, rubbish, nonrecylable paper, home repair debris, and trade wastes may be placed out for municipal collection after sunset of the day before collection and must be removed from the curbside by 9:00 p.m. of the day of collection in accordance with the rules and regulations of the Township.[1]

A. 
No more than five bags or approved containers, in accordance with § 187-13, or any combination thereof, containing garbage, rubbish, nonrecyclable paper, and trade wastes shall be placed out for any one municipal collection.
B. 
No more than two bulk items shall be placed out for any one municipal collection. No bulk item shall be of a weight or be of a size greater than can be safely handled by two persons.
C. 
No more than two tied bundles or two containers, each weighing no more than 50 pounds, of home repair debris shall be placed out for any one municipal collection, which items shall be included within the limitation set forth in Subsection A above. All nails, tacks, staples or similar hazards not removed from home repair debris shall be bent over and flattened so as to reduce the risk of injury.
D. 
Any garbage, rubbish, nonrecyclable paper, home repair debris, or trade wastes not placed curbside in a proper manner and/or removed within the time limit set forth in § 220-15 shall, in its sole discretion, be removed by the Township in the interests of public health and safety, and the Township shall bill the owner of said property in the actual amount to remove the garbage, rubbish, nonrecyclable paper, home repair debris, or trade wastes, in an amount not to exceed $500. Failure of the owner of said property to pay said bill may result in a lien being placed upon the property.
The deposit of lawful materials in any lawfully operated sanitary landfill or incinerator is permitted.
Any person who violates any of the provisions of this article shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, Article II, General Penalty.
