A. 
Unless otherwise expressly stated, the following words and phrases shall be construed throughout this chapter to have the meanings herein set forth:
CANVASSER
Any person who travels from house to house in an effort to take orders for goods, wares or services.
PEDDLER
Any person who sells or offers to sell goods, wares or other commodities, traveling from place to place throughout the Township.
PERSON
Any natural person, partnership, association, firm or corporation.
SOLICITOR
A person who travels from house to house in an effort to solicit funds or donations for any cause, fund or charity.
TOWNSHIP
The Township of Upper Hanover, Montgomery County, Pennsylvania.
B. 
For purposes of this chapter, the singular shall include the plural and vice versa.
It shall be unlawful for any person to engage in activity as a canvasser, peddler or solicitor, calling at residences within the Township without the previous consent of the occupant for the purpose of soliciting orders, sales, subscriptions or business of any kind or seeking information or donations, without first having registered in the office of a Township officer to be determined by resolution of the Board of Supervisors to be passed at the time of adoption of this chapter, as may be amended from time to time by similar resolution. The registrant shall truthfully give his complete identification, his signature and the name of his employer, the nature of the products or services in which he is interested, the names of the manufacturers or suppliers of such products, and the organization which he is representing and the proposed method of operation in the Township.
At the time of application, each registrant shall pay to said Township officer for the use of the Township a registration fee, to be set by resolution of the Board of Supervisors.

Each applicant, upon provision of the information required in § 336-2 hereof and payment of the fee provided in § 336-3 hereof, shall be furnished a certificate indicating registration, which certificate shall be effective for a period of 30 days from the date of issuance thereof. Each person shall at all times while soliciting or canvassing in the Township carry upon his person the registration certificate, and the same shall be exhibited by such registrant whenever he is required to do so by any police officer or by the person solicited.

The provisions of this chapter shall not apply to officers or employees of Upper Hanover Township, the Upper Hanover Authority, Montgomery County, the Commonwealth of Pennsylvania or the United States of America when on official business, nor shall it apply to persons engaged in political or religious advocacy.
Upon due notice, and after affording opportunity to be heard, any such registration may be revoked by the Township because of any violation by the registrant of the terms of this chapter or any other ordinance of the Township or of any statute of the commonwealth or United States of America.
The practice of going in and upon private residences in the Township by solicitors, peddlers and canvassers not having been requested or invited so to do by the owner or owners, occupant or occupants of said private residences for the purpose of soliciting orders for the sale of goods, wares and merchandise and/or for the purpose of disposing of and/or peddling or hawking the same, without the certificate required by this chapter, is hereby declared to be illegal.

No person shall engage in activity as a canvasser, peddler or solicitor, calling at residences without the previous consent of the occupants for the purpose of soliciting orders, sales, subscriptions or business of any kind or seeking information or donations, on Sundays or after the hour of 7:00 p.m. prevailing time. Further, such activity shall not be conducted in any manner as to result in a breach of the peace of the Township and the occupants thereof.
Any person who violates any of the provisions of this chapter shall be subject, upon conviction before a Magisterial District Judge, to pay a fine of not more than $300 and costs of prosecution and, in default of the payment of such fine and costs, imprisonment in the county jail for not more than five days.
