A. 
As a result of the suburban character of the Town of LaGrange, there are located within its boundaries many private land uses which serve the general public or a significant, though select, group of individuals. The life, health, safety and general welfare of the users of such facilities are endangered when, as a result of prolonged or severe ice and snow conditions, unobstructed access to the premises is limited beyond a reasonable time.
B. 
This article is enacted pursuant to § 10 of the Municipal Home Rule Law to provide for the general safety of persons and property within the Town and in furtherance of its fire prevention powers.
As used in this article, the following terms shall have the meanings indicated:
INTERIOR ROADWAY
The internal access system for motor vehicles serving a property, whether or not such system complies with municipal specifications for a road or accessway and whether or not it is designated as other than a road on any official document.
It shall be the obligation of every owner of a land use hereinafter defined to maintain the interior roadway upon his premises in a condition reasonably free from snow and ice so as to render it easily passable by vehicular traffic.
A. 
The owners of the following categories of land uses shall be subject to the requirements of this article:
(1) 
Apartment complexes containing an interior roadway, the length of which exceeds 500 feet measured along the center line of said system, or containing 25 individual residential units.
(2) 
Industrial parks, factories and offices containing an interior roadway, the length of which exceeds 500 feet measured along the center line of said system, or employing more than 25 individuals.
(3) 
Residential subdivisions containing an interior roadway which exceeds 500 feet measured along the center line of said system and containing at least one occupied dwelling.
(4) 
Shopping centers which contain an interior roadway which exceeds 100 feet measured along the center line of said system.
B. 
This article shall not apply to any land use not specifically set forth herein.
No highways within subdivisions for which there are unpaid fines as a result of proceedings instituted pursuant to this article shall be accepted for dedication until said fines have been fully paid. Said fines are to be fully paid notwithstanding the fact that the fines may have been levied against predecessors in title.
All interior roadways shall be cleared of snow and ice within 24 hours after the cessation of a snow, ice, ball, sleet or similar-type storm causing a snow accumulation inhibiting vehicular traffic.
This article shall be enforced by the Zoning Administrator of the Town of LaGrange.
Each and every violation of the provisions of this article shall be deemed an offense punishable by a fine not exceeding $2,000 for each such violation. Each day's continued violation of this article shall constitute a separate and additional violation. The Town Board may also maintain any action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this article, notwithstanding the penalty provisions hereof.
