It shall be lawful for any authorized organization, as defined in § 476 of Article 14-H of the General Municipal Law, upon obtaining the required license, to conduct the game of bingo within the territorial limits of the Town of Newstead, subject to the provisions of this chapter, Article 14-H of the General Municipal Law and Article 19-B of the Executive Law and the following restrictions:
A. 
No person, firm, association, corporation or organization, other than a licensee under the provisions of this chapter, shall conduct such game or shall lease otherwise make available for conducting bingo a hall or other premises for any consideration whatsoever, direct or indirect.
B. 
No bingo games shall be held, operated or conducted on or within any leased premises if rental under such lease is to be paid, wholly or partly, on the basis of a percentage of the receipts or net profits derived from the operation of such game.
C. 
No authorized organization licensed under the provisions of this chapter shall purchase, lease or receive any supplies or equipment specifically designed or adapted for use in the conduct of bingo games from other than a supplier licensed under the Bingo Control Law[1] or from another authorized organization.[2]

D. 
The entire net proceeds of any game of bingo and of any rental shall be exclusively devoted to the lawful purposes of the organization permitted to conduct the same.
E. 
No prize shall exceed the maximum amount set by New York State Law as the same may be amended from time to time.

F. 
No series of prizes of any one bingo occasion shall aggregate more than the maximum amount set by New York State Law as the same may be amended from time to time.

G. 
No person except a bona fide member of any such organization shall participate in the management or operation of such game.
H. 
No person shall receive any remuneration for participating in the management or operation of any game of bingo.
I. 
Limited period bingo shall be conducted in accordance with the provisions of Article 14-H of the General Municipal Law and the rules and regulations of the State Racing and Wagering Board.
J. 
No person licensed to sell bingo supplies or equipment, or their agents, shall conduct, participate in, or assist in the conduct of bingo. Nothing herein shall prohibit a licensed distributor from selling, offering for sale, or explaining a product to an authorized organization, or installing, or servicing bingo equipment, upon the premises of a bingo game licensee.[3]

Each applicant for a license shall file with the Town Clerk of the Town of Newstead a written application therefor in the form prescribed in the rules and regulations of the State Racing and Wagering Board.
The Town Clerk of the Town of Newstead shall cause to be investigated the qualifications of each applicant for a license and the merits of each application with due expedition after the filing of the application.

If the Town Clerk of the Town of Newstead shall determine that the requisite conditions have been met by the applicant, the Town Board shall issue a license to the applicant for the holding, operation and conduct of the specific games of chance applied for upon payment of a license fee as established by General Municipal Law § 481, as amended from time to time, for each occasion upon which any games of chance are to be conducted under the license, which fees are to be paid to the general fund of the Town of Newstead.

If the Town Clerk of the Town of Newstead shall determine that the requisite conditions have not been met by the applicant for the issuance of a license, he shall deliver to the Town Board of the Town of Newstead the application, together with the supporting documents therefor and the report of his investigation, whereupon the Town Board shall, upon due notice to the applicant, hold a hearing upon the qualifications of the applicant and the merits of the application.

On or before the 30th day of each month, the Supervisor of the Town of Newstead shall transmit to the State Comptroller a sum as may be established by the State of New York and/or the State Comptrollers office from time to time, per occasion of all license fees collected by the Town of Newstead pursuant to this chapter during the preceding calendar month.
The unauthorized conduct of a bingo game and any willful violation of any provision of this chapter shall constitute and be punishable as a misdemeanor.
