The agreement[1] between the township[2] and the Borough is hereby adopted, ratified and confirmed.

For purposes of the Act,[1] the pertinent terms and provisions of the agreement are as follows:
A. 
While maintaining all responsibility for and to its police officers, the Borough shall provide routine and emergency first police response services to the school district campus,[2] including that portion which lies situate in the township.

Editor's Note: In the preamble of Ord. No. 2002-3, "School District Campus" is defined as the high school and middle school campus, including the athletic stadium, constructed by the Downingtown Area School District.
B. 
The initial term of the agreement is for a period of two years from adoption of the agreement by Borough Council with one year renewals thereafter unless terminated by 180 days' notice by either party.
C. 
The purpose and objective of the agreement is to provide necessary first police response services to the school district campus in both the Borough and the township where the Borough police can better police the area because they know the students and geography and are located closer than the township police. Borough police officers serving within the township retain all usual police authority to enforce the laws of the Commonwealth of Pennsylvania and ordinances of the township. However, said officers remain employees of the Borough and not the township.
D. 
The Borough is financing its obligations under the agreement through appropriations under its Police Department budget.
E. 
The Borough's Police Department and municipal government are the only organizational structures necessary for implementation of the agreement.
F. 
The Agreement contemplates no acquisition, management, licensing or disposal of real or personal property.
G. 
The Borough retains all rights and obligations for group insurance, employee benefits and social security for all its police officers under the agreement.
