The members of the police force of the Borough of Hanover may
consist of a Chief of Police, a Lieutenant, five Sergeants and such
number of patrolmen as Council may from time to time prescribe.

Every member of the police force shall be appointed by the Borough
Council from a list of eligible applicants certified to the Borough
Council by the Police Civil Service Commission of the Borough in the
manner prescribed by law and shall hold his position until his voluntary
retirement or until his removal for cause in the manner prescribed
by law or until he shall reach the age of 60 years, at which time
he shall automatically be retired from active duty; provided, however,
that in no event shall a member be compelled to retire prior to attaining
eligibility for pension benefits as established by the Borough of
Hanover for members of the police force. Policemen automatically retired
by reason of age shall be subject to service as police reserve until
unfitted therefor by age or disability, when they may be finally discharged.
While on duty as a police reserve, they shall be paid as wages, in
addition to any regular pension, such sum as the Council may determine.[1]

A.Â
For
the purpose of determining the amount of salaries payable to and the
competency of the members of the police force, the following classifications
are hereby established for all members of the police force, with the
exception of the Chief of Police:

All appointees, as members of the police force, with the exception of the Chief of Police and present members of the police force, shall be classified at the time of their respective appointments as probationary patrolmen. Hereafter, all members of the police force, with the exception of the Chief of Police, shall submit to periodic examination by the Police Civil Service Commission of the Borough for advancement to next higher pay grade or pay increment, as hereinafter defined within the salary schedule under § 75-4, regardless of whether the next higher pay grade or increment falls in a new classification or within the present classification of the respective member. Such examination shall be held at such intervals as the Police Civil Service Commission, with the approval of Council, shall determine.

The salaries of the members of the police force shall be fixed
by resolution of Council.

The supervision of the members of the police force in the performance
of the ordinary duties of their respective offices shall be vested
in the Mayor.

The Police Civil Service Commission is hereby authorized and
empowered to adopt, subject to the approval of the Borough Council,
rules and regulations as to any and all matters affecting the police
force.
This chapter shall become effective on the first day of June
1942.

A.Â
Prior to making a warrantless arrest under § 8902 of Title
42 of the Pennsylvania Consolidated Statutes (42 Pa.C.S.A. § 8902),
the police officer shall ensure that the following requirements contained
in the statute are satisfied:
(1)Â
That the police officer has probable cause to believe that one of
the four offenses listed in 42 Pa.C.S.A. § 8902(a)(1) is
involved;
(2)Â
That the defendant's conduct is ongoing;
(3)Â
That the conduct constituting the offense is upon the police officer's
view; and
(4)Â
That the conduct imperils the personal security of any person or
endangers public or private property.
B.Â
After making a warrantless arrest pursuant to § 8902 of
Title 42 of the Pennsylvania Consolidated Statutes (42 Pa.C.S.A. § 8902),
the police officer shall follow Rule 440 (Arrest Without Warrant)
and Rule 441 (Procedure Following Arrest Without Warrant) of the Pennsylvania
Rules of Criminal Procedure, as may be amended from time to time.
