The position of Borough Administrator of the Borough of Madison is hereby created, and employment of a qualified person for that position is hereby authorized.
[Amended 6-14-1976 by Ord. No.15-76; 11-13-1995 by Ord. No. 49-95; 3-12-2007 by Ord. No. 6-2007]The Borough Administrator shall qualify, be appointed and serve a term of office in accordance herewith:
A. Appointment. The Borough Administrator shall be appointed pursuant to the provisions of N.J.S.A. 40A:9-136 et seq.
B. Term of office. The term of the first Borough Administrator appointed after the adoption of this chapter shall expire December 31, 1971. Subsequent appointments thereafter shall be for four-year terms with provisions for suspension or removal as set forth in Subsection C.
(1) The Borough Administrator may be removed at any time by a two-thirds vote of the Borough Council. The resolution of removal shall become effective three months after its adoption by the Borough Council. The Borough Council may provide that the resolution shall have immediate effect; provided, however, that the Borough Council shall cause to be paid to the Administrator forthwith any unpaid balance of his or her salary and his or her salary for the next three months following adoption of the resolution, unless the cause for such removal is the result of the conviction of said Administrator of an indictable offense of a subject matter relating to his or her employment.
(2) The Borough Administrator, upon receipt of a resolution of removal properly approved, may reply within 10 days of receipt and request a public hearing. A public hearing, if any, shall be held not earlier than 15 days nor later than 30 days after the request is received by the Borough Council. The findings of the hearing and the decision of removal shall be by written resolution approved by a two-thirds vote of the Borough Council.
(3) If the Borough Administrator is restored to his or her position, he or she shall be entitled to any compensation lost by reason of such suspension. Also, if after once being formally appointed to a four-year term he or she is not subsequently reappointed, the Borough of Madison shall pay his or her salary for three calendar months following the failure to reappoint.
D. Qualifications. The Borough Administrator shall be appointed on the basis of administrative qualification. A master's degree in public administration, or similar advanced degree, including other master’s degrees, or law degree, with a minimum of five years of work experience in government is required. No elected member of the Borough Council or Mayor may receive such appointment during his or her term of office nor within one year after the expiration of said term.
During any approved absence or disability of the Borough Administrator, an officer or employee of the borough may be appointed by the Borough Council to temporarily perform the duties and responsibilities of the position.
The compensation of the Borough Administrator shall be fixed by the Borough Council in a Salary Ordinance of the borough. Editor's Note: For information pertaining to the Salary Ordinance, see Ch. 42, Salaries and Compensation.
A. The Borough Administrator shall act as the chief administrative officer of the borough. His duties shall include the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments, personnel management and general coordination of departments, offices, boards and agencies of the borough, all for the purpose of increasing the effectiveness and efficiency of the borough government and promoting its economic operation. All rules and regulations promulgated by the Borough Administrator shall be subject to the approval of a majority vote of the Borough Council. The Borough Administrator shall perform the duties hereinafter enumerated and such other duties as may be assigned to him by the Mayor with the consent of the Borough Council.

B. He shall act as the chief administrator of the borough government and, as such, will supervise all salaried personnel of the borough through the respective department heads, unless otherwise provided for by law or by this chapter. He shall not engage in any other occupation or employment while employed by the borough, except as assigned by the Mayor and Council.
C. He shall coordinate the functions of all departments, boards, agencies, offices, officials and employees of the borough and shall maintain liaison with the Board of Education of the Borough of Madison, authorities and commissions. Editor's Note: Former Subsection D, which contained specific duties and responsibilities, which immediately followed this subsection, was repealed 11-13-1995 by Ord. No. 49-95. This ordinance also provided for the relettering of Subsections E through L as Subsections D through K, respectively.
D. He shall collect all data and prepare a proposed budget annually for consideration by the Mayor and Council on or before February 10 of each year, after obtaining requests for appropriations from all departments of the borough and consulting with all department heads. Said proposed budget shall be accompanied by the proper supplemental detail in support of the proposed budget appropriation with a comparison of the prior year's expenditure and an analysis of the proposed expenditures with recommendations regarding the feasibility thereof. Upon adoption of the budget, current accounts of the expenditures made shall be kept on a monthly basis, based upon the supplemental detail of the adopted budget.

E. He shall require the Finance Director to furnish annually an accounting of fixed assets owned by the borough and recommend the sale of any surplus, obsolete equipment, materials and supplies.

F. He shall prepare and have custody of all municipal records not required by law to be kept by another officer of the borough and establish and ensure the maintenance of a coordinated filing system for all borough departments, offices, boards and agencies.
G. He shall:
(1) Keep the Mayor and Council currently informed on all matters within his jurisdiction by submitting such reports as he deems advisable or as requested by the Mayor and Council.
(2) Prepare and present to the Mayor and Council an annual report on borough matters.
(3) Make such other reports as from time to time the Mayor and Council may require.
H. He shall:
(1) Advise the Mayor and Council on all matters of administration, organization and personnel and assign office personnel to the performance of various duties in various departments.
(2) Study, recommend, implement and enforce personnel organization and policy of the borough, and implement vacation policy as established by the Borough Council for all departments, except as otherwise provided by statute for Police and Fire Departments. I. He shall:
(1) Study, recommend, implement and enforce procedures and policy of the borough and its departments for receipt, dissemination and collation of and responses to communications and requests for information, after consultation with department heads.
(2) Receive, distribute and follow up requests for information and complaints from citizens and keep the Mayor and Council informed on such matters.
J. He shall prepare an agenda for and arrange meetings and conferences of the Mayor and Council and other agencies of the borough when so requested by the Mayor and Council.
K. He shall attend all meetings of the Mayor and Council, unless excused by that body.
Nothing herein shall derogate from or authorize the Borough Administrator to exercise the powers and duties of elected officials of the borough and of the boards and agencies thereof established pursuant to law.
