The Town of Milan, Dutchess County, New York, owns and is in possession of certain parcels of real property situated in said Town and hereby determines it necessary and in the best interests of said Town and its inhabitants to limit and restrict the use of said real property to the end that certain types of vehicles and means of travel and transportation are prohibited thereon, namely motorcycles, mopeds, motor scooters, snowmobiles, all-terrain vehicles, licensed and unlicensed motor vehicles, licensed and unlicensed adaptations of motor vehicles, dune buggies, bicycles and any and all other types of vehicles or recreational vehicles propelled by other than human power. The purpose of such prohibition is in the interest of protecting said real property itself and persons present upon and using said real property, including operations of such vehicles as described.
A. 
No person shall possess, use, take upon or permit another to possess, use or take upon any real property of the Town of Milan, Dutchess County, New York, other than Town highways, any motorcycle, moped, motor scooter, snowmobile, all-terrain vehicle, licensed and unlicensed motor vehicle, licensed and unlicensed adaptations of motor vehicles, dune buggy, bicycle and any and all other types of vehicles or recreational vehicles propelled by other than human power.
B. 
The aforesaid real property shall include, but is not limited to, that surrounding the Wilcox Memorial Town Hall, Route 199, Town of Milan, New York, the South Road recycling and recreation areas and the Town highway premises on Academy Hill Road, Town of Milan, New York.
Any person violating the foregoing § 189-2 shall be guilty of a violation and shall be subject to a fine not exceeding $250 and a sentence of imprisonment not to exceed 15 days in jail for each such violation, or both.
