A. 
There shall be a Liquor License Commission which is hereby authorized to issue all new or renewal licenses for the sale of alcoholic beverages within the town, both as to on-premises and package services.
B. 
The Liquor License Commission shall be composed of three members. The members shall be appointed by the Mayor in accordance with the provisions of MGL C. 138, § 4. (See MGL C. 138 generally as to state regulation of sale of alcoholic beverages.)

It shall be unlawful for any person to possess, consume from and/or transport an open container of alcoholic beverages on any public street, public sidewalk or public way or on any grounds owned by the town, state and county or any other municipalities within the limits of the town, except that this section shall not apply to events or festivals duly licensed by the Liquor License Commission or officials of the Town of Agawam having care and custody of the premises so licensed, to the extent of such license approval. A person who is found to possess, consume from and/or transport an open container of alcoholic beverage on any public street, public sidewalk or public way, or on any grounds owned by the town, within the limits of the town may be arrested by a police officer and kept in custody in a convenient place, not more than 24 hours, Sunday excepted, until a complaint can be made against him for the offense, and he be taken upon a warrant issued upon such complaint. A fine may be imposed for not more than $200 for this offense.
