[Amended 5-15-2006 by TOR-2006-2]
A.
General requirements. The owner of land on which is located a surface storm drainage easement shall not cause or permit the same to become clogged or any water flow into or through the same to be impeded by debris, siltation, vegetation (in excess of what is needed to control erosion), the placement of any structure or otherwise; nor shall the owner cause or permit any condition to exist, such as loss of suitable ground cover, which would contribute to the erosion or siltation of the drainage channel. Any continuing violation of this section after reasonable notice from the Superintendent shall entitle the Town to enter onto the easement to repair or correct the offending condition and bill the costs thereof to the owner.
B.
Detention ponds; maintenance requirements. Detention ponds within easements to the Town of Agawam require minor maintenance to be performed by the property owner on a regular basis.
(1)
Remove clogs to the outlet structure caused by leaves, branches, grass clippings, or other debris.
(2)
All grassed areas must be mowed a minimum of two times per year (spring and fall) to reduce weed growth. If areas become bare, they must be reseeded to sustain vegetative cover.
(3)
Detention ponds and swales may not be filled in or altered such that the intended design and functioning of the drainage system is impaired.
(4)
Landscaping, fences, or other utilities or structures may not be placed so that access to the detention pond or drainage structures is impaired.
(5)
The area surrounding the fenced detention area is to be maintained and kept landscaped or grassed.
