A. 
No owner or operator of a motor vehicle shall park the same unattended on any Town street or highway or county highway within the Town of Chenango between the hours of 1:00 a.m. and 7:00 a.m. from November 15 to April 15 of each year.
B. 
It is the purpose of this chapter to promote the public health, safety and general welfare and to permit the free use of Town and county highways, free of snow and winter conditions for all of the traveling public.
The motor vehicles in violation hereof may be towed away by or at the direction of the Highway Superintendent of the Town of Chenango and impounded until reasonable towing and storage costs are paid.
The Highway Superintendent shall maintain appropriate signs at all main entrances to the Town of Chenango between November 15 and April 15 of each year stating "No Parking on Town Streets and Highways and County Highways within the Town of Chenango between the hours of 1:00 a.m. and 7:00 a.m."
Any person violating any of the provisions of this chapter shall be guilty of a traffic infraction and may be punished upon conviction as hereinafter, or as set forth in the Vehicle and Traffic Law of the State of New York.
A. 
First offense: $50.
B. 
Second offense: $75.
C. 
Third offense: $100.
Should any section, paragraph, sentence, clause or phrase of this chapter be declared unconstitutional or unjust for any reason by a court of competent jurisdiction, the remainder of this chapter shall not be affected thereby.
This chapter is adopted pursuant to the provisions of the Town Law of the State of New York and the Motor Vehicle and Traffic Town Law and the Motor Vehicle and Traffic Law of the State of New York.
All ordinances, local laws, and parts thereof inconsistent with this chapter are hereby repealed.
This chapter shall take effect immediately upon filing with the New York State Secretary of State in accordance with § 27 of the Municipal Home Rule Law.
