In all parks, recreational areas, parking areas and other public places owned by the Incorporated Village of Rhinebeck, Dutchess County, New York, excluding streets and highways, the following rules and regulations shall apply.
All parks, parking areas, recreational areas and other public places owned by the Village, except the area known and designated as the Community Parking Lot on the northerly side of East Market Street, shall be open for use by the general public only between the hours of sunrise and sunset, and no person, firm or corporation is permitted to use or be upon the same for any purpose whatsoever at any other time, except by special written permit of the Village Board.
Said Community Parking Lot shall be open for use by the general public at all hours of the day and night, but only for the purpose of parking motor vehicles and for access to and from said motor vehicles and the public streets and sidewalks, except by special written permit of the Village Board.
The opening of containers of or the consumption of alcoholic beverages at or upon the premises of any such park, recreational area, parking area or other public place owned by the Village is prohibited except by special written permit of the Village Board.
No person, firm or corporation shall, at any time, operate, leave or park any motor vehicle, motorcycle, automobile, snowmobile, moped or other motorized vehicle of any type or nature whatsoever, not including, however, bicycles, tricycles or children's toys, except in areas and at such times as specifically designated or otherwise provided for such purposes, in or upon any park, recreational area, parking area or other public place owned by the Village.
Any person who violates any of the foregoing regulations shall be guilty of a violation and punishable by a fine not to exceed $25 or 15 days' imprisonment, or both, for a first offense; $50 or 30 days' imprisonment, or both, for a second offense; and $100 or 60 days' imprisonment, or both, for each subsequent offense.[1]
