The purpose of this chapter is to provide for
the operation, maintenance and regulation of Round Lake's water delivery
system, that is, the system of water pipes, mains, conduits, storage
facilities, water meters, valves, pumping facilities and chlorination
facilities from the point of connection to a water source (e.g., reservoir,
Water Authority, or other public or private water company or system)
to that point at which the water transported in such system has passed
through a water meter installed by or with the written consent of
the Village of Round Lake. The water delivery system shall be operated
by the Superintendent of Public Works or a Water Superintendent, if
one is appointed.
A.
No person, other than an employee of the Village of
Round Lake or a person authorized in writing by the Superintendent
of Public Works, shall tap any main or water pipe or tap any pipe
laid for the purpose or with the intent of supplying water to themselves
or to other persons or premises or for other purposes than those for
which such pipes were first permitted to be laid.
B.
No water main may be tapped after November 1 or before
April 1 in each year, except in extraordinary circumstances and as
may be permitted by the Superintendent of Public Works.
C.
A building permit must be obtained from the Village
of Round Lake before any main or water pipe is tapped. All such tapping
shall be done under the supervision of a Village Public Works employee.
The tapping must be completed by a qualified and insured contractor
authorized to do so in writing by the Superintendent of Public Works.
The Board of Trustees of the Village of Round
Lake may promulgate regulations to implement and control the operation
and maintenance of a water delivery system and set fees and usage
rates in connection with the same. Such regulations may be enacted,
modified or repealed by resolution of the Board.
A.
Tampering:
No person shall interfere or tamper with the water delivery system,
including, but not limited to, opening or closing valves; opening
or damaging fire hydrants; diverting or conversion of water; opening
or tampering with water meters; severing, breaking or damaging any
pipes or valves; or entering, climbing or defacing the Village's water
tower or pumping station.
B.
Cross-connecting:
No person shall allow a cross-connection with any other source of
water, or make an act inconsistent with or in violation of New York
State Health Regulations.
C.
Contamination:
No person shall contaminate the water delivery system, including,
but not limited to, adding any substance or permitting the addition
of any substance to the water in the water delivery system. The water
delivery system shall not be used as an electrical ground, except
as permitted by the applicable building code.
A.
The following persons are authorized and empowered
to issue appearance tickets for violation of any of the provisions
of this chapter or regulations promulgated thereunder: the Superintendent
of Public Works; a Water Commissioner; and/or Code Enforcement Officer.
B.
Every person using water from the water delivery system
or who is obligated by law to connect to the water delivery system
shall permit the Superintendent of Public Works, Water Commissioner
and/or Code Enforcement Officer, and/or their assistants or agents,
to enter upon any premises under that person's custody or control
at all reasonable hours to examine the manner and extent to which
the water is used, to confirm that cross-connections have not been
made, and to inspect and read water meters.
C.
The Superintendent of Public Works or Water Superintendent
shall, at the direction of the Board of Trustees, have the full right
at all times whenever, in the Board's opinion, the public good or
necessity requires or demands to regulate, diminish or entirely cut
off the supply of water from any and all parties taking water, and
the Board may make all such regulations and rules for the use or for
diminishing the use thereof as it deems proper. The Village shall
not be liable for any damages caused which may result from such action.
Any violation of this chapter or the regulations promulgated hereunder shall constitute an unclassified misdemeanor and a violator shall, upon conviction, be fined a minimum of $150 and a maximum of $500 or imprisoned in the County Jail for not more than 15 days, or be both so fined and imprisoned, and further, these rules and regulations and ordinances may be enforced by injunction, except that a conviction of contamination under § 175-4C shall carry a mandatory fine of $1,000.
