The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
BOARD
The Board of Canvassers and Registration of the Town as created by this article.
There is hereby created a Board of Canvassers and Registration of the Town.
The Board shall consist of three qualified electors of the Town, not more than two of whom shall be adherents of the same political party.
The Town Council shall elect the original members and all subsequent members of the Board from a list of not less than five qualified electors for each office submitted to the Town Council by the Chairman of each of the two political parties whose candidate for governor received the greatest number of votes in the Town in the next preceding general election. If the Chairman of either political party fails or refuses to submit such list for a period of 30 days after the expiration of any term or the happening of any vacancy, the Town Council may elect any qualified elector known to the Town Council to be an adherent of such political party.
No person shall be appointed or serve as a member of the Board who is an officer or employee of the United States, or of the state, or of any city or town in the state. Any member of the Board who becomes a candidate for election to any public office and who fails to file a declination of such candidacy within the time allowed by law shall be disqualified from holding membership on the Board, and the Town Council shall elect his successor forthwith.
The terms of the original members of the Board shall be staggered. Thereafter, the term of office shall be for six years beginning on the first Monday of March succeeding the date of appointment. Each member shall serve until his successor is elected and qualifies. In case any person elected as a member of the Board shall decline to serve or neglect to qualify, or if a vacancy shall occur in the Board for any cause, such office or vacancy shall be filled by the Town Council in like manner for the term of office or for the unexpired term.
Every person elected to the Board shall, before entering upon his duties, be sworn to the faithful performance thereof, and a record of such oath shall be kept by the Clerk of the Board.
The compensation of the members of the Board shall be fixed by the Town Council from time to time.
The Board shall elect one of its members as its presiding officer.
The Town Clerk shall be ex officio the Clerk of the Board.
The Town Council hereby transfers to and vests in the Board all rights, powers and duties now vested or which in the future may be vested in the Town Council by virtue of the provisions of the Constitution or of any and all acts of the General Assembly concerning nominations, elections, registration of voters, and preparing, canvassing and correcting the lists of voters in the Town, and all matters relating thereto.
Nothing contained in this article shall be deemed to affect the powers and duties of the Town Clerk concerning nominations, elections, registration of voters, preparing and correcting the lists of voters and other matters relating thereto, as they are now exercised by the Town Clerk pursuant to state law.
