The Town Council shall have the power and duty to enforce this article.
No private street, highway or road shall become part of the public highways of the Town unless and until the street, highway or road is accepted by order of the Town Council after compliance with the provisions of this article.
The Town Council may waive or modify any requirement of this article but, before doing so, shall hold a public hearing, first giving notice of the time and place of such hearing and the matter to be acted on by advertisement in some newspaper having general circulation within the Town, once a week for two successive weeks.
Any person in interest may make request of the Town Council for the acceptance of a private street or highway upon an application on such form as is prescribed by the Town Council and furnished by the Town Clerk. Such person shall also file with such application any pertinent maps, drawings or other information as may be from time to time prescribed by the Town Council.
The Town Council may, in its discretion, require that a conveyance be filed with an application made pursuant to this article, conveying to the Town any right, title or interest which any person may have in and to the fee to such street or highway.
A. 
An application filed under this article shall be referred to the Director of Public Works to give his approval or disapproval to the acceptance of the street or highway.
B. 
No street or highway shall be accepted unless the Director of Public Works shall certify that:
(1) 
Such street or highway is actually of the width described in the application.
(2) 
The grades and curves of such street or highway do not constitute serious traffic hazards.
(3) 
A grade of such street or highway has been established consistent with the land adjacent thereto.
(4) 
Provision has been made for the proper drainage of such street or highway.
(5) 
Such street or highway has a foundation suitable to the Director of Public Works.
(6) 
All loam has been scraped from the surface of such street or highway; and that such street or highway has a foundation of gravel of six inches to 12 inches, as required by the Director of Public Works.
(7) 
The surface of such street or highway, for a width of at least 30 feet, has been treated with one coat of penetration oil, tar, asphalt or similar substance, and an additional coat of sealing oil, tar, asphalt or similar substance; that such pavement is in good condition; and that the outside five feet on either side of such street or highway is to be used for a sidewalk.
(8) 
The acceptance of such street or highway as a public street or highway will serve the convenience and necessity of the general public.
In order to be accepted under this article, a street or highway shall be at least 40 feet in width. The Town Council may, in its discretion, require a greater width.
If a street or highway, the acceptance of which is applied for under this article, bears a name, such name shall not conflict with the name of any other public street or highway in the Town.
