A permit shall be defined as a written application
filed by a person with the Town Clerk's office seeking permission
to plant, cut, trim, prune or remove, in full or in part, any shrub,
ornamental or shade tree located on Town roads or in public places
under the control of the Tree Warden within the Town. Neither the
Town Tree Warden nor the Department of Public Works is required to
obtain permits under this definition. A person securing the permit
from the Town shall abide by the arboricultural standards of practice
recognized by the State Department of Environmental Management and
shall also abide by all state and local regulations governing arboricultural
practices.
A.
It shall be permissible for any person to plant, cut,
trim, prune or remove in whole or in part any shrub, ornamental or
shade tree located at or near Town roads or in public places under
the control of the Tree Warden if the permit application has been
received by the Town Clerk at least 48 hours in advance of the times
stated on the permit that work is to be commenced.
B.
The permit shall designate the location at all times
within the limits of the Town where the work is to be performed, the
manner in which it is to be performed and the expiration date of the
permit.
C.
The permit and application fees under this chapter shall be assessed at the rates set forth in Chapter 122, Fees, for the first two trucks or work crews employed by any person working in the Town daily and for each truck or work crew utilized in the Town each day beyond the two trucks or two work crews.[1]
