As used in this article, the following terms
shall have the meanings indicated:
The residue from fires.
Includes any refuse from animal and vegetable matter and
foodstuffs after it has been used as food, refuse from the kitchen,
market, house or store, floor sweepings, table waste or animal or
vegetable matter, vegetables, meats, fish, bones, fat and all offal
and organic waste substance.
Includes one or more persons of either sex, natural persons,
corporations, partnerships, associations, joint-stock companies, societies,
clubs and all other entities of any kind capable of being sued.
Includes combustible trash, including but not limited to
paper, cartons, boxes, barrels, wood, tree branches, yard trimmings,
grass clippings, leaves, wood furniture and bedding; noncombustible
trash, including but not limited to metal, tin cans, metal furniture,
dirt, rock, pieces of concrete, glass, crockery, other sweepings and
contents of litter receptacles; and oil, gas, animal bodies, animal
excretion and human excretion.

A.
It shall be unlawful for any person to throw, spill,
place, deposit, leave or cause to be thrown, spilled, placed, deposited
or left, or to permit any servant, agent or employee to throw, spill,
place, deposit or leave, in or upon any street, highway, alley, sidewalk,
park or public building, in or within 20 feet of the bank of any running
water or body of water within the Town of Clifton Park, in any catch
basin or storm sewer drain or in any other public place in the Town
of Clifton Park, any garbage, refuse, rubbish, ashes or unwholesome
or putrescible matter of any kind.
B.
Any person who drops, or permits to be dropped or
thrown, upon any roadway any destructive or injurious material or
any material which interferes with the safe use of the roadway shall
immediately remove the same or cause it to be removed. Any person
removing a wrecked or damaged vehicle from a roadway shall remove
any glass or other injurious substance dropped upon the roadway from
such vehicle.
C.
Throwing refuse on streets and adjacent lands prohibited.
No person shall throw, dump, deposit or place, or cause to be thrown,
dumped, deposited or placed, upon any street, or within the limits
of the right-of-way of such street, or upon private lands adjacent
thereto, any refuse, trash, garbage, litter or any nauseous or offensive
matter.

Nothing herein contained shall be construed as prohibiting
the use, in a reasonable manner, of ashes, sand, salt or other material
for the purpose of reducing the hazard of, or providing traction on,
snow, ice or sleet.
(2)
Nothing herein contained shall be construed as prohibiting
the use of any street or private lands adjacent thereto for the transport
or transit of agricultural trucks, machines or implements or dairy
or animals or agricultural stock with any accompanying reasonable
or unavoidable deposit of nauseous or offensive matter.
A.
Any person who commits or permits any act or acts
in violation of any of the provisions of this article shall be guilty
of a violation and shall, upon conviction thereof, be liable to a
penalty or fine of not more than $250 or imprisonment for not more
than 15 days, or both such a fine and imprisonment, for each and every
offense. Each day such violation shall continue or be permitted to
exist shall constitute a separate violation or offense.

B.
Any person violating this article shall be subject,
in lieu of criminal action, to a civil penalty enforceable and collectible
by the Town in an amount of $200 for each such offense. Such penalty
shall be collectible by and in the name of the Town for each day that
such violation shall continue.
C.
In addition to the above-provided penalties and punishments,
the Town Board may also maintain an action or proceeding in the name
of the Town in a court of competent jurisdiction to compel compliance
with or to restrain by injunction the violation of this article.
