This local law shall be known and may be cited as "Local Law No. 12-1985 of the Town of Clifton Park, a Local Law Amending Local Law No. 2-1967 of the Town of Clifton Park, Entitled 'Local Law Relating to Zoning for the Town of Clifton Park,'[1] Providing for the Creation of a Planned Development District To Be Known as `Planned Development District No. 27, Stony Creek Village.'"

Chapter 208, Zoning, of the Code of the Town of Clifton Park and the Zoning Map of the Town of Clifton Park as set forth therein and made a part thereof are hereby amended by changing from Residence District R-1 a portion thereof as hereafter described and creating a planned development district to be known as "Stony Creek Village" within the boundaries of said area.
Stony Creek Village consists of plus or minus 23.0 acres located in the southerly portion of the Town of Clifton Park, north of Crescent Road and west of Moe Road and east of Bonneau Road and south of Tenby Drive and is more particularly described in Exhibit A attached and made a part hereof.[1]

A. 
The development of Stony Creek Village is depicted by a sketch plan filed with the Town Planning Board of the Town of Clifton Park, a copy of which is attached hereto as Exhibit B.[1]

B. 
Stony Creek Village will be improved by no more than 126 dwelling units located in townhouse buildings containing three to six such dwelling units. Approximately 16.5, plus or minus, acres will be designated as common open space to remain undeveloped and to be owned and maintained by a homeowners' association.
C. 
Development of the improvements to be located at Stony Creek Village will follow and be based on said sketch plan. Any aspect of this sketch plan, except the number of dwelling units, may be changed, altered or amended by approval of the Town Planning Board.
Before construction of Stony Creek Village is commenced or any building permit relating thereto is issued, final plans and specifications, including open areas and roadways, shall be submitted to the Town Planning Board for its approval and to the Town Board for its approval. The final plans and specifications shall be filed with the Town Clerk and the County Clerk after approval by the Town Planning Board and by the Town Board.
For vehicular traffic purposes, there will be two points of ingress to and egress from Stony Creek Village, and each of such points will be located on Crescent Road as shown on the sketch plan of Stony Creek Village, or such other or different points of ingress and egress as the Town Planning Board may determine as part of the site plan review.
Water will be supplied by the Crescent Estates Water Company, a transportation corporation. Sanitary sewer service shall be provided by the Crescent Estates Waste Disposal Corporation and by a connection to the Saratoga County Sewer District No. 1 on Tenby Drive. Stormwater runoff shall be collected in three stormwater management areas located on the site and gradually released by outfall pipes to the existing storm sewer system.
All improvements shall be subject to the direction and control of a duly licensed architect and/or engineer and constructed pursuant to plans and specifications approved by a duly licensed engineer and/or architect and in strict compliance with the New York State Uniform Fire Prevention and Building Code Act. When completed, these improvements shall be certified as having been constructed in full compliance with the New York State Uniform Fire Prevention and Building Code Act. The engineer and/or architect performing the work herein described shall be employed by and at the sole expense of the developer. All construction shall be subject to the inspection and approval of the Town of Clifton Park.
A. 
This amending local law shall be automatically revoked and void and the previous statutory regulations shall apply under the following circumstances:
(1) 
Commencement of the construction of Stony Creek Village has not begun within 12 months from the effective date of this local law; or
(2) 
Substantial progress is not being made without undue interruption after construction has commenced.
B. 
This local law shall not be voided and shall continue in full force and effect with respect to each building constructed pursuant to this law, plus an additional area of 50 feet of open space beyond the outside boundaries of each such building constructed. For proper cause shown, the Town Board may, under such terms and conditions as it deems proper, waive, by resolution, the requirement that substantial progress shall continue without undue interruption.
