This local law shall be known and may be cited as "Local Law No. 15-1990 of the Town of Clifton Park, a Local Law Amending Local Law No. 2-1967 of the Town of Clifton Park entitled 'Local Law Relating to Zoning for the Town of Clifton Park,[1] Providing for the Creation of a Planned Development District To Be Known as 'PDD No. 33, Crescent Point West.'"

Local Law No. 2-1967 of the Town of Clifton Park, entitled "Local Law Relating to Zoning for the Town of Clifton Park" and any and all prior and subsequent amendments thereto affecting the subject premises, and the Zoning Map of the Town of Clifton Park as set forth therein and made a part thereof, are hereby amended by changing from Residence District R-1, a portion thereof, as hereinafter described, and creating within the boundaries of said newly described area a planned development district to be known and described as "Planning Development District No. 33, Crescent Point West."
The area of said Planned Development District No. 33, Crescent Point West, consists of approximately 60.94 acres of land located southerly of Boyack Road and Dorsman Drive, westerly of Amity Point Court and easterly of Grissom Drive and is bounded and described in Exhibit A attached hereto and made a part hereof.[1]

There shall be constructed within the area of said Planned Development District No. 33, Crescent Point West, parking areas, detached single-family dwellings, recreational facilities, open space and public streets, all as set forth on a preliminary site plan entitled "Crescent Point West," a copy of which is annexed hereto.
Development of the improvements to be located in the planned development district will follow and be based upon said preliminary site plan. Any aspect of this preliminary site plan may be changed, altered or amended by the Town Planning Board without further action of the Town Board, except, however, there shall be no townhouses or condominiums constructed on the site.
There shall be up to 85 single-family homes. There shall be no more than 17 dwellings (single-family detached units) constructed in any one calendar year commencing from the date of final Planning Board approval. No building shall exceed two stories in height. There may be constructed an entrance sign which shall be in accord with the Town of Clifton Park Sign Law.[1]

Water will be supplied by the Crescent Estates Water Company or any successor owner, and sewer service will be provided by the Crescent Waste Treatment Corporation or any successor owner.
Before construction of the planned development district is commenced or before any building permit relating thereto is issued, final plans and specifications shall be submitted to the Town Planning Board for its approval and shall be approved by the Town Planning Board. Such final plans and specifications shall be filed with the Town Clerk and the Town Planning Board, after approval thereof by the Town Planning Board, and shall be governed by the time frames for approval as set forth in § 276 of the Town Law.
There is hereby incorporated in this local law and made a part hereof by reference the site plan review and approval process, set forth in Local Law No. 2-1967,[1] so long as the site plan review and approval process does not conflict with § A217-249 above. The site plan approved by the Planning Board shall require that all dwellings and accessory buildings comply with the Town Code requirements for dwelling units in an R-1 zone district, except as amended herein and by the attached site plan, and including setback lines with respect to positioning of buildings, unless variances therefrom are secured from the Planning Board and/or Zoning Board of Appeals.

All improvements shall be designed and constructed pursuant to plans and specifications approved by a duly licensed architect and/or engineer and in full compliance with the New York State Uniform Fire Prevention and Building Code and the Code of the Town of Clifton Park. All construction shall be performed subject to the direction and control of a duly licensed architect and/or engineer and, when completed, shall be certified as having been constructed in full compliance with the New York State Uniform Fire Prevention and Building Code. The plans and specifications shall be approved by the Town Planning Board, and, following such approval by the Town Planning Board, such plans shall be filed in the office of the Town Clerk. The architect and/or engineer performing the work herein shall be employed by and at the sole expense of the developer. All construction performance thereon, and upon completion, shall be subject to the inspection and approval of the Town Building Inspector. This local law shall incorporate those conditions set forth in the conditioned negative declaration of the Planning Board made pursuant to SEQRA and dated April 23, 1990.
Chapter 208, Zoning, § 208-3, Zoning Map, is hereby amended by providing that said Planned Development District No. 33, Crescent Point West, be set forth on Supplementary Map No.____ , which is hereby made a part of this local law.
