A.
Act 60 of 1995 of the Commonwealth of Pennsylvania, known as the "Second Class Township Code" provides in Section 606 thereof[1] for the compensation of Township Supervisors and, further, provides therein that Supervisors of Townships having a population between 10,000 to 14,999 may be compensated in an amount not to exceed $3,250 per annum. The population of East Whiteland Township, according to the 2010 United States census, the most recent official census, is 10,650.

Editor's Note: See 53 P.S. § 65606.
B.
Said Act authorizes the Board of Supervisors to set the compensation of Supervisors subject to the limitations set forth in the Act, and subject to the constitutional and public policy limitations of the commonwealth which precludes application of an ordinance increasing elected officials' compensation to those elected officials serving a term of office at the time the ordinance is adopted, unless they have been elected to a new term of office commencing after the effective date of the ordinance.
A.
Beginning January 1, 2021, any East Whiteland Township Supervisor elected, reelected or appointed to office on or after November 3, 2020, shall receive compensation as a Supervisor in the annual sum of $3,250, payable quarterly on a pro rata basis.
B.
Supervisors elected, reelected or appointed to office after the effective date of Ordinance No. 77-85, as amended by Ordinance No. 121-97, but before November 3, 2020, shall continue to receive annual compensation in the amount therein provided for, subject to their right to such greater compensation as provided for herein upon their reelection to office subsequent to the effective date hereof.
Ordinance No. 77-85, as amended, and Ordinance No. 121-97, as amended, are amended only to the extent provided for herein; otherwise, they shall remain in full force and effect.
