Any person who violates or permits the violation of any provision of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a District Justice, pay a fine for each such violation in an amount not less than $100 and not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the Township. No judgment shall be imposed until the date of the determination of a violation by the District Justice. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable rules of civil procedure. In addition to other remedies, the Township may institute and maintain appropriate actions at law or in equity to restrain, correct or abate violations of this chapter.
It shall be unlawful for any person to commence or engage in the business of constructing or operating cable television systems in the Township of East Whiteland without being awarded, or having duly executed an agreement awarding a franchise under this chapter. Township reserves the right to build its own cable television communications system without granting itself a franchise.
It shall be unlawful for any person, firm, or corporation to make any unauthorized connection, whether physically, electronically, acoustically, inductively, or otherwise, with any part of the franchisee's cable television or telecommunication system within the Township for the purposes of enabling himself or others to receive any television or radio signals, picture, program, or sound, without payment to the operator of said system in accordance with the then current rate schedule.
The Township will cooperate with the franchise to prevent theft of service wherever possible.
It shall be unlawful for any persons, without the consent of the subscriber (residential/commercial), to unlawfully tamper, remove, or injure any cable, wires or equipment used for distribution of television signals, radio signals, pictures, programs, sound, or data connection.
