Any construction or excavations being undertaken on a lot must be accomplished
without damage to any abutting Township street. Equipment must be unloaded
and loaded on the lot when possible. No tracked equipment may be driven on
Township streets unless adequate protection is provided for the road surface.
Any damage to the pavement, curbing or shoulders of a Township street caused
by the parking or movement of construction equipment or trucks must be restored
by the property owner or contractor at his expense. Damage shall include,
but shall not be limited to, oil spills and the scarring of the pavement and
curbing. The area damaged must be cut out and replaced in accordance with
Township specifications.
The contractor constructing a new building or structure or an addition
to an existing building or structure must file with the Township a maintenance
bond as set from time to time by resolution of the Board of Supervisors if
the work involved will occur on a lot that fronts a Township street or a completed
street to be dedicated to the Township. The bond shall remain in effect until
the work is finished and must guarantee the repair of any damage done to the
pavement, curbing, shoulders or any other improvement located within the right-of-way.
All earth and/or debris dragged onto a Township street from a lot under
construction or excavation must be removed by the contractor before the end
of the work day.
Any person, firm, corporation or utility who violates or permits the
violation of any provision of this article shall, upon being found liable
therefor in a civil enforcement proceeding commenced by the Township before
a District Justice, pay a fine for each such violation in an amount not less
than $100 and not more than $600, plus all court costs, including reasonable
attorney's fees, incurred by the Township. No judgment shall be imposed until
the date of the determination of a violation by the District Justice. If the
defendant neither pays nor timely appeals the judgment, the Township may enforce
the judgment pursuant to the applicable rules of civil procedure.
