A. 
General. The boundaries of this Aircraft Flight Path District are indicated on the Zoning Map and are based on data presented in the Comprehensive Plan of the Township. Additional information can be obtained on this district from the Height Limitation Zoning Map of the Lehigh Valley International Airport and the Airport Zoning Resolution of Northampton County, Pennsylvania.
B. 
Permitted uses. Only the following uses or building types shall be permitted in this district, except for nonconforming uses or buildings as provided for in Article XI:
(1) 
Agriculture and agricultural operations, except as may be limited by the use regulations of the primary district.

(2) 
Public and private recreational uses and activities such as public parks, picnic grounds, golf courses, boat launching, hiking and horseback riding trails, wildlife and nature preserves, game farms, fish hatcheries.
(3) 
Cemeteries.
(4) 
Residential uses: single-family detached houses subject to the provisions of this chapter for the R1-R District.
C. 
Area and bulk regulations.
(1) 
To facilitate development, area and bulk regulations otherwise governing uses shown in Subsection B(1), (2) and (3) may be modified by the Planning Commission, subject to the approval by the Board of Supervisors at the time of site plan review.
(2) 
Area and bulk regulations for uses shown in Subsection B(1), (2) and (3) not otherwise presently specified in this chapter will be established by the Planning Commission subject to the approval of the Board of Supervisors at the time of site plan review.
D. 
Special exceptions. Only the following building types or uses shall be permitted pursuant to Zoning Hearing Board requirements of Article XIV:
(1) 
Permitted and accessory uses in the residential, commercial or employment district in which the lot is situated, subject to the following restrictions:
(a) 
With 40% or more of the total area of the lot being situated within the Aircraft Flight Path District, then the minimum lot size shall be increased by 100%.
(b) 
Maximum lot coverage or maximum densities allowed in any district shall be reduced by a factor of 50%.
(2) 
Site design considerations. Buildings and structures should be so located on a lot to avoid, to the maximum extent possible, the detrimental effects of the aircraft flight path.
E. 
Site plan approval.
(1) 
If a lot is in or partially within this district, site plan review by the Planning Commission and approval by the Board of Supervisors shall be required.
(2) 
The required site plan shall contain at least the following information:
(a) 
Location, size, and orientation of the lot in the district, with notes describing the superimposed restrictions from the Height Limitation Zoning Map of Lehigh Valley International Airport and the Airport Zoning Resolution, as they might apply.
(b) 
Location, size, and orientation of the buildings within the lot, with notes describing what measures taken in building siting and proposed construction quality to protect future property values from the environmental impact of the aircraft flight path.
