As used in this chapter, the following terms shall have the meaning indicated:
APPROVED INCINERATOR
A metal drum of adequate capacity, a masonry incinerator, or a steel or iron receptacle with solid or perforated sides, fronts and backs used to burn any type of combustible material. All draft doors or openings and the top shall be completely covered with perforated metal or wire screening with openings not exceeding 1/2 inch in length and width.
GRILL, BARBECUE or OUTDOOR FIREPLACE
Any masonry or metal structure used only for outdoor cooking and not for the disposition of any materials specified in the definition of "outdoor fire" below.
OUTDOOR FIRE
Any fire in the open air or outside the confines of a building for the purpose of:
A. 
Burning woodland, grassland, swampland, leaves or forest debris.
B. 
Burning as a means of disposing of papers, cartons, rubbish, garbage or any other combustible material when such burning is done in the open air, outside of a structure.
C. 
Burning as a means of disposal of all or any part of any structure or vehicle, including automobiles, boats and aircraft, and the burning of debris from any of the foregoing.
PERMIT
Written permission from the Fire Marshal, or any person designated by him/her to issue outdoor burning permits, stating the name of the person to whom it is issued, location, time and conditions governing its use.
A. 
No person shall kindle an outdoor fire within the Town of Killingworth without a permit, except in an approved incinerator, an outdoor grill or fireplace used for cooking.
B. 
Special permits will be issued for land clearing, with appropriate restrictions as to time, location and supervision.
C. 
No person shall kindle an outdoor fire within 50 feet of any building or other structure; adequate provision must be made to prevent the fire from spreading to within 50 feet of any building, structure or combustible material in an uncontrolled manner.
D. 
Burning of the following materials is prohibited at all times: tires, oil wastes, fuel oil, garbage, animal wastes (in or out of an incinerator), motor vehicles and parts removed from motor vehicles, or any materials that emit large amounts of smoke, with the exception of wood, grass, leaves, cartons and paper which may be burned under controlled conditions with a permit issued for the purpose of eliminating dangerous fire hazards.
E. 
Permits will not be issued under any of the following circumstances:
(1) 
A hazardous health condition will be created.
(2) 
A salvage operation will be conducted.
(3) 
A practical alternative method of disposal is available.
(4) 
A period of air pollution alert.
Outdoor burning shall be confined to the period between sunrise and sunset unless authorized by the Fire Marshal.
All outdoor fires, except in an approved incinerator, shall be constantly attended by at least one competent person until such fire is extinguished. Such person shall have adequate extinguishing equipment readily available for immediate use.
An approved incinerator shall not be located within 15 feet of any structure or any combustible material.
The Fire Marshal may prohibit any or all outdoor fires when atmospheric or other conditions make such fires dangerous or hazardous to health and safety.

Any person who violates provisions of this chapter is subject to arrest and a fine of $250.
