It is the legislative intent of this Town Board to clarify, by this chapter, the structure, functions and duties of the various departments and officials within this Town government heretofore dealing with all aspects of public works so as to permit and foster the orderly operation of the public works functions and responsibilities of the government of the Town of Greenburgh.
There is hereby established for the unincorporated area of the Town of Greenburgh a Department of Public Works, hereinafter called the "Department."
The principal executive officer and administrative head of the Department shall be the Commissioner, who shall be appointed by the Town Board for a term of two years, pursuant to and in accordance with §§ 53-c and 64(21-a) of the Town Law, and at such salary as may from time to time be fixed by the Town Board. The Commissioner shall be appointed on the basis of his administrative experience and qualifications for the duties of such office and such additional standards as may be required by the Town Board. The Commissioner shall be the head of the Department, with power and authority to appoint and remove employees under his jurisdiction, in accordance with the Civil Service Law.

There may be a Deputy Commissioner, who shall have such powers and duties as are prescribed by the Commissioner and who shall generally act for and in place of the Commissioner.
A. 
The Commissioner shall have such powers as shall be necessary for the proper administration of the Department, consistent with applicable provisions of law.
B. 
The Department shall be divided into the following divisions under the control and direction of the Commissioner as follows:
(1) 
Division of Engineering, which shall design, develop and prepare plans and specifications for all capital construction and supervise implementation of projects, in accordance with Chapters 210 and 430 of the Town Code and any other applicable laws or ordinances.
(2) 
Division of Highways, which shall clean, maintain and rehabilitate all Town roads, in conformance with the federal and state highway laws, Chapter 430 of the Town Code and any other applicable laws or ordinances.
(3) 
Division of Sanitation, which shall collect and dispose of all raw garbage and refuse, as provided for in Chapter 410 and 240 of the Town Code and any other applicable laws or ordinances.
(4) 
Division of Equipment Maintenance, which shall maintain and repair all mechanical equipment owned and operated by all the agencies of the Town and/or the villages within the Town, at their request.
(5) 
Division of Parks Maintenance, which shall provide the daily maintenance of all park facilities in the unincorporated area of the Town.
(6) 
Division of Building Maintenance, which shall provide general maintenance and rehabilitation of all buildings owned and/or leased by the Town of Greenburgh.
(7) 
Division of Traffic Devices, which shall manufacture and install all traffic signs and line all Town and village roads, as provided in Chapter 460 of the Town Code, the New York State Manual of Uniform Traffic Devices and any other applicable laws or ordinances.
(8) 
Division of Communications, which shall operate the base radio station and maintain and repair all communication equipment for all departments within the Town and/or the villages, at their request.
(9) 
Division of Street Lighting, which shall maintain and install all streetlighting equipment for the unincorporated area of the Town.
(10) 
Division of Water and Sewer, which shall maintain the entire water and sewer grid systems throughout the Town, including the operation and maintenance of pumping stations and all related facilities, and continue to purchase water for and bill the residents of the Town pursuant to the Rules and Regulations of the Consolidated Water Districts, all pursuant to Chapters 160, 465 and 470 of the Town Code and any other applicable laws and ordinances.
A. 
The powers and duties of the Divisions of the Department shall be under the administrative direction and control of the Commissioner of Public Works.
B. 
The Commissioner, acting by and through any of the divisions, shall be empowered to perform such other duties and functions that are prescribed to be performed by him in any law, ordinance or resolution of the Town Board, or lawful direction of the Supervisor.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in §§ 29, 52 and 125 of the Town Law of the State of New York, or any other powers which may be lawfully exercised by said Supervisor.
The Commissioner may establish, subject to Town Board approval, a schedule of fees to be collected by him for services rendered in connection with the work of the Department and for which he deems it necessary to charge and to collect a fee therefor.
