All forms of entertainment, professional or nonprofessional,
in any restaurant, cabaret, inn or hotel within the confines of the Town shall
cease at 12:01 a.m. (prevailing legal daylight or standard daylight time)
on each and every day of the week, except January 1 of any year, at which
time all forms of entertainment, professional or nonprofessional, shall cease
at 2:00 a.m. Entertainment as referred to in this chapter shall not commence
prior to 11:00 a.m. of any day of the week.
B.Â
The owner, proprietor, and/or manager of any restaurant,
cabaret, inn or hotel within the confines of the Town shall have the responsibility
to fully terminate all forms of entertainment, professional or nonprofessional,
at the time designated hereinabove.
Any owner, proprietor and/or manager of any restaurant, cabaret, inn
or hotel within the confines of the Town who shall fail to terminate, or fail
to take all available steps to terminate, all forms of entertainment, professional
or nonprofessional, shall be guilty of an offense and, upon conviction thereof,
be punishable by a fine of $250 or by imprisonment for a term not exceeding
15 days, or by both such fine and imprisonment.
As used in this chapter, the following terms shall have the meanings
indicated:
Includes any live or mechanical means of entertainment, paid for
or voluntarily contributed, professional or nonprofessional. It shall specifically
include any performance by any entertainer, guest, patron, owner or manager.
