[HISTORY: Adopted by the Town Board of the Town of Pound Ridge 3-11-1971 as L.L. No. 3-1971. Section 108-3 added at time of adoption of Code; see Ch. 1, General Provisions, Art. I. Other amendments noted where applicable.]
Upon the effective date of this chapter, property owners and their agents, contractors and employees shall be required to first obtain a permit from the Building Inspector of the Town of Pound Ridge before commencing the drilling of any well. The application for such permit shall be on forms supplied by the Building Inspector and shall include a vicinity sketch sufficient to establish the location of the well and shall be accompanied by a statement of the purpose for which the well is to be installed. Except as provided by § 108-2 of this chapter, a permit shall be issued by the Building Inspector upon satisfactory proof that the proposed well conforms to applicable rules and regulations of the Westchester Department of Health.
An application to dig any well, except one intended solely as a source of domestic water supply for a one-family residential structure, shall be classified by the Building Inspector as a well intended for nondomestic water supply, and in such case the application to dig such well shall be referred to and be subject to review and special permit to be issued by the Water Control Commission of the Town of Pound Ridge.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
